HomeMy WebLinkAboutCity Council Resolution 2016-323 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-323 R ESOLUTION A PPROVING A F INAL P LAT FOR L AKE W EST TH D EVELOPMENT, LLC FOR “F RETHAM 24 S ECOND A DDITION” FOR P ROPERTY L OCATED S OUTH OF 715 C OTTONWOOD L ANE (2016072F) WHEREAS, Lake West Development, LLC. has requested approval of a final plat for one lot and one outlot on land presently legally described as follows: th Outlot A, Fretham 24, Hennepin County, Minnesota, and The north 60 feet of the south 390 feet of the west 180 feet of the southeast quarter of the northeast quarter of Section 35, Township 118, Range 22, Hennepin County. WHEREAS, city staff has prepared an agreement covering the stormwater improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Lake West Development, LLC. for a final th plat for Fretham 24 Second Addition, and: FURTHER, that the agreement for said off-site stormwater improvements related to said plat be approved, and that upon prior execution of the agreement by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and, FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. A final plat is approved for one single-family lot in accordance with the plans received by the city on August 10 and 30, 2016, except as may be amended by this resolution. 2. Prior to commencement of grading operations or recording the final plat, the developer shall: a. Execute the stormwater agreement and submit the related cash deposit to pay for construction of the pond shown in the south half of the development with a future phase or submit the necessary easements and construct the pond at this time. b. Receive approval of a grading permit. c. Install and request inspection of tree preservation fencing and silt fencing. d. Submit an approved NPDES permit. e. Pay the required park dedication fee for one dwelling unit. f. Post a refundable cash deposit for setting of iron monuments (property stakes). g. Revise the plat to consolidate Outlot A into Lot 1, Block 1. Res. 2016-323 File 2016072 Page 2 h. Receive approval of final construction plans. 3. Standard Conditions: a. No building permits shall be issued until the final plat is filed and recorded with Hennepin County and the grades have been certified to be consistent with the approved grading plan by the project engineer. b. Development standards and setbacks for this plat shall comply with the RSF-2 zoning standards. No variances are granted or implied. c. Any signage shall require separate permits and shall comply with the city’s sign regulations. d. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. e. Compliance with the city’s tree preservation regulations. f. Removal of all hazardous trees at the owner's expense. g. No trees shall be planted in the boulevard. h. This approval shall expire two years after the date of approval, unless the property owner or applicant has applied for final plat approval, or unless the applicant, with the consent of the landowner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
