HomeMy WebLinkAboutCity Council Resolution 2016-314 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-314 R ESOLUTION A PPROVING A S ITE P LAN A MENDMENT AND C ONDITIONAL U SE P ERMIT A MENDMENT FOR P ROPERTY L OCATED AT 1695 S TATE H IGHWAY 169 (2016065) WHEREAS, CNH Architects has requested approval of a site plan amendment and conditional use permit amendment to allow construction of an approximately 4,920 square-foot two story office building addition in the I-3 (heavy industrial) zoning district and related site improvements for the property presently legally described as follows: Tract B, Registered Land Survey No. 1567, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by CNH Architects for a site plan amendment and conditional use permit amendment for a building addition and related site improvements, subject to the following conditions: 1. A site plan amendment is approved to allow construction of an approximately 4,920 square- foot two story office building addition and related site improvements, in accordance with the plans received by the city on August 1 and 3, 2016 and September 13, 2016, except as amended by this resolution. 2. A conditional use permit amendment is approved to allow the expansion of an office building located in the I-3 (heavy industrial) zoning district with the finding that the proposal complies with all applicable conditional use permit standards. 3. A separate building permit is required prior to commencement of the project. 4. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Execute a site improvement performance agreement and submit the financial guarantees and fees pursuant to section 21045.10 of the zoning ordinance. b. Obtain an erosion control permit from the Bassett Creek Watershed District. c. Obtain city approval of final construction plans. d. Submit an executed cross access easement for utilities for the relocated private sanitary sewer pipe with the property to the south. e. Submit details and receive approval of the proposed permeable pavement area including subsurface details. Resolution 2016-314 File 2016065 Page 2 f. Submit additional light fixture details including backlight, uplight, and glare (B.U.G.) ratings consistent with LZ2 pursuant to section 21105 of the zoning ordinance. g. Revise the plans as follows: i. On the landscape plan, revise the location of the fence along the south property line to meet fire inspector requirements, including but not limited to, not blocking the PIV and fire department connection with any obstruction. ii. Revise the fence details to show support posts no greater than four inches above the fence structure. iii. Add proposed lowest floor elevation to grading plan. iv. Identify existing hydrant locations on the utility plan and work with the fire inspector on additional hydrant location if needed. v. Add the city’s fire lane sign detail. 5. Fire lane signage shall be provided in locations along the south property line and entrance drives to be field identified by the fire inspector. 6. The east and west drive aisles must be paved to 7 ton capacity and a minimum of 20 feet wide. 7. The addition shall be protected with an approved fire sprinkler system. 8. A fire inspector approved sign shall be installed at the fire department connection. 9. The exterior wall treatment of the trash enclosure shall be similar and/or complement the principal building pursuant to section 21120.02 of the zoning ordinance. 10. Prior to the issuance of a certificate of occupancy, the applicant shall submit an as-built certificate of elevation demonstrating the lowest floor elevation is at least two feet above the 100-year base flood elevation (890 feet) pursuant to section 21660 of the zoning ordinance. 11. Any new proposed exterior lighting fixture shall meet current zoning ordinance standards pursuant to section 21105.06. 12. Standard Conditions: a. Silt fence shall be installed prior to any construction on the site. b. No trees may be planted in the public right-of-way. c. Any visible mechanical equipment shall be painted or screened to match the building consistent with section 21130.05 of the zoning ordinance. d. Retaining walls over four feet require issuance of a building permit and a minimum three- foot fence installed on top. e. Any signage shall receive separate sign permits and comply with section 21155 of the zoning ordinance. f. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. Resolution 2016-314 File 2016065 Page 3 g. The site plan amendment and conditional use permit amendment shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21015.07, respectively, of the zoning ordinance.
