HomeMy WebLinkAboutCity Council Resolution 2016-307 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-307 R ESOLUTION A PPROVING S ITE P LAN, V ARIANCE, AND F INAL P LAT FOR A N EW C OMMERCIAL B UILDING ALONG THE S OUTH S IDE OF 61 ST A VENUE/S HENANDOAH L ANE (2016063) WHEREAS, PAL Associates, LLC has requested approval of a site plan, variance and final plat to allow construction of an approximately 5,100 square foot multi-tenant commercial building for the property presently legally described as follows: Outlot A, Taryn Hills Commercial Second Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by PAL Associates, LLC for a site plan, variance, and final plat for a new commercial building, subject to the following conditions: 1. A site plan and final plat are approved to allow construction of an approximately 5,100 square foot multi-tenant commercial building and related site improvements, in accordance with the plans received by the city on July 20 and 22, 2016 and August 24 and 26, 2016, except as amended by this resolution. 2. A variance is approved to allow a 28-foot setback from the front property line where 35 feet is required, with the finding that the proposal complies with all applicable variance standards. 3. The requested variance: 1) would be in harmony with the general purposes and intent of the zoning regulations; 2) would address the practical difficulties related to developing a lot of irregular shape; 3) is not based exclusively upon economic considerations; 4) would not be detrimental to the public welfare or injurious to other land or improvements in the area; 5) would not impair an adequate supply of light and air to adjacent properties, nor would it increase traffic congestion, increase the danger of fire, endanger the public safety, or substantially diminish property values within the neighborhood; and 6) is the minimum action required to alleviate the practical difficulties. 4. A separate building permit is required prior to commencement of the project. 5. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Record the final plat with Hennepin County. Resolution 2016-307 File 2016063 Page 2 b. Execute a site improvement performance agreement and submit the financial guarantees and fees pursuant to section 21045.10 of the zoning ordinance. c. Pay the park dedication fee in lieu of land dedication, in accordance with the dedication ordinance in effect at the time of building permit issuance (current rate is a maximum of $8,000 per acre for commercial development). d. Pay the watermain area charge, in accordance with the charges in effect at the time of building permit issuance (current amount would be $4,297.59). e. Pay the sanitary sewer area charge, in accordance with the charges in effect at the time of building permit issuance (current amount would be $1,157.31). f. Obtain any required permits from the Elm Creek watershed district and NPDES. g. Obtain city approval of final construction plans. h. Submit executed (or provide copies of previously executed documents) cross access easements for utilities, parking and maintenance of the property. i. Revise the plans as follows: i. On the landscape plan, include at least 6 overstory or 6 overstory equivalent trees and show where the new trees are to be added. ii. Use different line types to differentiate the existing utilities and proposed utilities. iii. Add the watermain connection location to the building. iv. Change the location of the watermain in the southwest corner of the plan to not run through a sanitary sewer manhole. v. Recommend installing the watermain a minimum 10 feet from the building. vi. Indicate the post indicator valve and the fire department connection in a location approved by the fire inspector. vii. Add the city’s fire lane sign detail. viii. Add an approved solenoid valve to the plans. ix. Identify the watermain size. x. Relocate the hydrant to an approved location within 75 feet of the fire department connection. 6. The drive aisle south of the site to the north of the Walgreens building shall be a westbound “one-way” drive aisle from Walgreens toward the Super America and Foundation Hill site, and shall be indicated with appropriate pavement markings and signed “do not enter” from the west. 7. Fire lane signage shall be provided in locations to be field identified by the fire inspector. 8. Any new proposed exterior lighting fixture shall meet current zoning ordinance standards pursuant to section 21105.06. 9. Standard Conditions: a. Silt fence shall be installed prior to any construction on the site. b. No trees may be planted in the public right-of-way. c. Any visible mechanical equipment shall be painted or screened to match the building consistent with section 21130.05 of the zoning ordinance. Resolution 2016-307 File 2016063 Page 3 d. Retaining walls over four feet require issuance of a building permit and a minimum three-foot fence installed on top. e. Any signage shall receive separate sign permits and comply with section 21155 of the zoning ordinance. f. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. g. The site plan and variance shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under sections 21045.09 and 21030.06, respectively, of the zoning ordinance. h. The final plat shall expire two years after the date of approval, unless the applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of City Code.
