HomeMy WebLinkAboutCity Council Resolution 2016-292 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-292 R ESOLUTION A PPROVING F INAL P LAT AND D EVELOPMENT C ONTRACT FOR “L ANEWOOD E STATES” FOR PROPERTY LOCATED AT 14800 C OUNTY R OAD 47 (2016 040-F) WHEREAS, Lanewood Estates, LLC has requested approval of a final plat for Lanewood Estates for seven single-family lots on roughly 5.28 acres located at 14800 County Road 47. WHEREAS, the property is presently legally described as follows: That part of the West Half of the Northeast Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota, lying North of the centerline of County Road No. 47, except the North 1062.41 feet and also except the West 675.10 feet. Along with and subject to an easement for road purposes over the East 60.00 feet of the West 705.10 feet of said West Half of the Northeast Quarter lying North of said County Road. WHEREAS, city staff has prepared a development contract covering the improvements related to said plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and does approve the request by Lanewood Estates, LLC for a final plat for Lanewood Estates; and FURTHER, that the development contract for said plat be approved, and that upon prior execution of the development contract by the developer, the mayor and city manager be authorized to execute the development contract on behalf of the city; and FURTHER, that the following conditions be met prior to recording of, and related to said plat: 1. The final plat for seven single-family lots to be called Lanewood Estates is approved in accordance with the plans received by the city on August 15, 2016, except as may be amended by this resolution. 2. Prior to commencement of site development including grading operations, the developer shall: a) Install and request inspection of tree protection fencing and silt fencing. b) Obtain the necessary Hennepin County permits for work within the County Road 47 right-of- way. c) Obtain the required NPDES (National Pollutant Discharge Elimination System) permit. 3. Prior to recording the final plat, the developer shall: a) Remove the existing structures from the site. Demolition permits are required for removal of existing structures that contain over 120 square feet in floor area. Resolution 2016-292 File 2016040-F Page 2 b) Receive city approval of final construction plans. c) Execute the development contract and provide the related financial guarantees and fees, including the required park dedication fee. d) Obtain watershed approval. e) Obtain an encroachment agreement for retaining walls that would lie within a drainage and utility easement. f) Provide a ten-foot wide trail easement along the south boundary of the plat abutting County Road 47. g) Provide Homeowner’s Association (HOA) documents for city review showing that the subdivision will be incorporated into the Taryn Hills HOA. The HOA documents shall address: a) responsibilities for maintenance and repair of developer-installed retaining walls, wetlands, wetland buffers, buffer monuments, sidewalks, and any subdivision signage or other similar or common features; and b) prohibition of structures and clearing of native vegetation within wetland buffers. The HOA documents shall be recorded concurrent with the plat, and evidence of recording shall be provided to the city prior to issuance of building permits. 4. Prior to issuance of building permits for lots abutting wetlands, permanent wetland buffer monument signs shall be installed pursuant to ordinance requirements. 5. The sidewalk shall be extended southerly to the County Road 47 right-of-way to provide a connection to a future trail along the north side of County Road 47. 6. Construction access for this subdivision shall come from County Road 47 for grading operations, utility installation, and street and home construction, pursuant to the approved temporary access permit from Hennepin County. 7. The developer shall remove the existing temporary cul-de-sac turn-around located north of the plat boundary, and restore that area with sod. 8. Standard Conditions: a. No building permits, including those for a model home, shall be issued until the final plat is recorded with Hennepin County and streets and utilities are installed. b. Development standards and setbacks for this plat shall comply with the RSF-2 zoning standards. No variances are granted or implied. c. If the required sidewalks are not installed when the streets are installed, no building permits shall be issued for lots abutting the future sidewalk unless a separate sidewalk agreement is provided for each affected lot. d. Any signage shall require separate permits and shall comply with the city’s sign regulations. e. Separate building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. f. No trees shall be planted in the boulevard. g. Compliance with the city’s tree preservation and landscaping regulations. h. Removal of all hazardous trees at the owner's expense. Resolution 2016-292 File 2016040-F Page 3 i. This approval shall expire two years after the date of approval, unless the property owner or applicant has recorded the final plat, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 512 of city code.
