R ESOLUTION N O. 2016-284
R ESOLUTION A CCEPTING U TILITIES FOR C ONTINUAL M AINTENANCE
FOR M APLE C REEK M EADOWS (2015040)
WHEREAS, in accordance with the development contract dated August 5, 2015 and amended on
August 9, 2016, Lawndale 47, LLC, developer of Maple Creek Meadows (2015040), has agreed to install
certain improvements for said development; and
WHEREAS, the developer has completed a portion of the street, utility and site grading as noted
below; and
WHEREAS, the developer has requested a reduction of the required financial guarantee to
reflect the completed work.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA that the financial guarantee requirements are reduced as follows below and that the
required financial guarantee and Letter of Credit No. 313 for the items be reduced from $657,094 to
$550,067:

BE IT FURTHER RESOLVED that the financial guarantee requirements approved with the first
amendment to the development contract for the water and sewer extension can be reduced and that
the required financial guarantee and Letter of Credit No. 362 be reduced from $74,000 to $18,500.
BE IT FURTHER RESOLVED that the utilities are accepted for continuous maintenance as of
September 13, 2016, subject to the two-year guarantee by the Developer per Letter of Credit No’s. 313
and 362.
