HomeMy WebLinkAboutCity Council Resolution 2016-270 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-270 R ESOLUTION A PPROVING S ITE P LAN A MENDMENT FOR P ARKERS L AKE B APTIST C HURCH FOR P ROPERTY L OCATED AT 14720 C OUNTY R OAD 6 (2016035) WHEREAS, Parkers Lake Baptist Church has requested approval of a site plan amendment for exterior lighting upgrades at the property located at 14720 County Road 6; and WHEREAS, the subject property is legally described as: Parcel 1: Lots 9 and 10, Block 1, “Raths Second Addition”, according to the plat thereof on file or of record in the office of the Registrar of Titles in and for said County; and, Parcel 2: That part of Government Lot 2, Section 28, Township 118, Range 22 described as follow: Commencing at the intersection of a line drawn at right angles to the West line of said Government Lot 2 from a point thereon distant 694.27 feet South along said West line from the Northwest corner of said Government Lot 2 with the East line of said Government Lot 2, the point of beginning of the tract to be described, thence West along said right angle line to the intersection with a line drawn parallel with and 1020 feet East measured at right angles from the West line of said Government Lot 2; thence at a right angle South to the centerline of County Road No. 6; thence West along said centerline to its intersection with a line drawn parallel with and 820 feet East, measured at right angles from the west line of said Government Lot 2; thence south parallel with the west line of said Government Lot 2 to the southerly line of said Government Lot; thence easterly along said southerly line to the east line of said Government Lot 2; thence North along said East line to the point of beginning; except all that part thereof lying South of the centerline of Hennepin County State Aid Highway Number 6, Plat 5. Certificate of Title No. 616815 Outlot A, Cimmaron East according to the recorded plat thereof, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for a site plan amendment for lighting upgrades at 14720 County Road 6, subject to the following conditions and findings: 1. A site plan amendment is approved to allow the removal and replacement of the exterior lighting at the Parkers Lake Baptist Church property, in accordance with the application and plans received by the city on April 29, 2016, and additional information on June 24, 2016, and July 28, 2016, except as may be amended by this resolution. Resolution 2016-270 (2016035) Page 2 2. Separate building and electrical permits are required prior to the commencement of the project. No site alteration may occur prior to the issuance of applicable permits. 3. Prior to issuance of any permits, the following items shall be submitted or revised consistent with the zoning ordinance, city code and engineering guidelines: a. The applicant shall submit an executed agreement for the installation of the exterior lighting and provide financial guarantees that would cover the associated cost. b. The applicant shall acknowledge the curfew requirement for LZ1 in writing and provide specifications or documentation demonstrating new lighting can meet the requirement. 4. Pursuant to section 21105.06 of the zoning ordinance, all lighting fixtures mounted higher than 12 feet above grade shall be equipped with side shielding (house side shielding). 5. Any subsequent phases or expansions are subject to required reviews and approvals pursuant to ordinance provisions. 6. The approval is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. 7. The site plan amendment shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21045.09 of the zoning ordinance.
