R ESOLUTION N O. 2016-263
R ESOLUTION A PPROVING THE V ACATION OF A P ORTION OF S TREET E ASEMENT IN
L OT 1, B LOCK 1, G REENTREE F OREST 2 ND A DDITION
WHEREAS, a public hearing with respect to said vacation was scheduled for August 9, 2016, in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks
prior to the meeting of August 9, 2016 ; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by
mail; and
WHEREAS, the Council did hold a public hearing on August 9, 2016 to inform any and all
interested parties relevant to the vacation of a portion of an easement for street purposes in Lot 1,
Block 1, GREENTREE FOREST 2ND ADDITION ; and
WHEREAS, it was determined by the City Council that said easement was not needed for public
purposes;
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that the following portion of the street easement be vacated:
That part of the East 30.00 feet of Lot 1, Block 1, GREENTREE FOREST 2ND ADDITION, Hennepin
County, Minnesota, that lies southwesterly of the following described line:
Commencing at the Northeast corner of said lot 1; thence South 76 degrees 19 minutes 25
seconds West, assumed bearing along the northerly line of said Lot 1, a distance of 30.83 feet to
the West line of said East 30.00 feet; thence South 00 degrees 20 minutes 13 seconds East,
along said West line of the East 30.00 feet, a distance of 65.00 feet to the point of beginning of
said line to be hereinafter described; thence South 17 degrees 20 minutes 13 seconds East a
distance of 45.00 feet; thence South 27 degrees 11 minutes 54 seconds East a distance of 28.84
feet to the South line of said Lot 1 and said line there terminating.
FURTHER, it is not in the public’s interest to vacate the drainage and utility easement within the
street easement and it shall be retained by the City.
APPROVED by the City Council on this 9th day of August, 2016.
