HomeMy WebLinkAboutCity Council Resolution 2016-254 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-254 R ESOLUTION A PPROVING F INDINGS OF F ACT FOR THE R EZONING OF LAND LOCATED AT 17135 O LD R OCKFORD R OAD (2016044) WHEREAS, Landform Professional Services, LLC, has requested reclassification of the zoning from FRD (future restricted development) to RSF-2 (single family detached 2) for the roughly 4.7-acre site presently addressed as 17135 Old Rockford Road, and presently legally described as follows: THAT PART OF THE WEST HALF OF THE NORTHWEST QUARTER OF SECTION 17, TOWNSHIP 118 NORTH, RANGE 22 WEST OF THE 5 TH PRINCIPAL MERIDIAN, DESCRIBED AS BEGINNING AT THE SOUTHEAST CORNER OF THE WEST HALF OF THE NORTHWEST QUARTER OF SAID SECTION 17, THENCE NORTH ALONG THE EAST LINE OF SAID WEST HALF OF THE NORTHWEST QUARTER A DISTANCE OF 1334.59 FEET TO THE ACTUAL POINT OF BEGINNING OF THE LAND TO BE DESCRIBED, THENCE NORTH 88 DEGREES 29 MINUTES WEST A DISTANCE OF 449 FEET; THENCE NORTH AND PARALLEL TO THE EAST LINE OF SAID WEST HALF OF THE NORTHWEST QUARTER A DISTANCE OF 682.09 FEET, MORE OR LESS, TO THE CENTERLINE OF COUNTY ROAD NO. 9 (ALSO KNOWN AS ROCKFORD ROAD), THENCE EASTERLY ALONG THE CENTER LINE OF SAID COUNTY ROAD NO. 9 TO THE EAST LINE OF SAID WEST HALF OF THE NORTHWEST QUARTER; THENCE SOUTH ALONG THE EAST LINE THEREOF TO THE ACTUAL POINT OF BEGINNING, EXCEPT THE WEST 150 FEET OF THE NORTH 395 FEET THEREOF, ACCORDING TO THE U.S. GOVERNMENT SURVEY THEREOF, HENNEPIN COUNTY, MINNESOTA. AND THAT PART OF THE WEST HALF OF THE NORTHWEST QUARTER OF SECTION 17, TOWNSHIP 118 NORTH, RANGE 22 WEST OF THE 5 TH PRINCIPAL MERIDIAN, DESCRIBED AS COMMENCING AT THE SOUTHEAST CORNER OF THE WEST HALF OF THE NORTHWEST QUARTER OF SAID SECTION 17, THENCE NORTH ALONG THE EAST LINE OF SAID WEST HALF OF THE NORTHWEST QUARTER A DISTANCE OF 1334.59 FEET TO THE POINT OF BEGINNING OF THE LAND TO BE DESCRIBED, THENCE NORTH 88 DEGREES 29 MINUTES WEST A DISTANCE OF 449 FEET; THENCE SOUTH AND PARALLEL TO THE EAST LINE OF SAID WEST HALF OF THE NORTHWEST QUARTER A DISTANCE OF 48 FEET; THENCE NORTH 89 DEGREES 47 MINUTES 40 SECONDS EAST A DISTANCE OF 181.59 FEET; THENCE NORTH 83 DEGREES 13 MINUTES 25 SECONDS EAST A DISTANCE OF 83.92 FEET; THENCE NORTH 82 DEGREES 05 MINUTES 14 SECONDS EAST A DISTANCE OF 185.69 FEET TO THE ACTUAL POINT OF BEGINNING, ACCORDING TO THE U.S. GOVERNMENT SURVEY THEREOF, HENNEPIN COUNTY, MINNESOTA. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected parcel from FRD to RSF-2. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from FRD to RSF-2 for the roughly 4.7-acre site located at 17135 Old Rockford Road (as presently legally described above), based on the following findings: 1. The requested single-family use of the site is consistent with the LA-1 guiding of the site. Resolution 2016-254 (2016044) Page 2 2. The requested RSF-2 zoning would be consistent with the LA-1 guiding of the site. The proposed lot arrangement would comply with RSF-2 standards. 3. The density and RSF-2 zoning for the site would result in a development that would be compatible with the existing character and zoning of the adjacent properties. 4. Adequate infrastructure would be available to support RSF-2 zoning and the proposed development for the site. APPROVED by the City Council this 9th day of August, 2016.
