R ESOLUTION A PPROVING R EQUEST FOR P AYMENT N O. 3 AND F INAL
T RAFFIC S IGNALS AT S CHMIDT L AKE R OAD & F ERNBROOK L ANE, S CHMIDT L AKE R OAD
& C HESHIRE P ARKWAY, & S CHMIDT L AKE R OAD AND N ATHAN L ANE (8121 & 12010)
WHEREAS, the City of Plymouth as the owner and Egan Company as the contractor,
have entered into an agreement for the Traffic Signals at Schmidt Lake Road and Fernbrook
Lane, Schmidt Lake Road and Cheshire Parkway, and Schmidt Lake Road and Nathan Lane, said
agreement was approved by the City Council on September 8, 2015; and
WHEREAS, the Engineer has certified his acceptance of the work and his approval of the
final request for payment.
NOW, THEREFORE BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA:
1. That the original contract amount was $962,925.25 and that the value of the work
to date is $970,448.50 and is herewith approved. The final contract amount is
$7,523.25 or 0.78% above the original contract amount.
2. That the work performed by the contractor for the traffic signals at Schmidt Lake
Road and Fernbrook Lane, Schmidt Lake Road and Cheshire Parkway, and Schmidt
Lake Road and Nathan Lane are certified to the Council by the engineer as
acceptable, being the same, is hereby released from the contract except as to the
conditions of the performance bond, any and all legal rights of the owner,
required guarantees and correction of faulty work after final payment.
3. Request for Payment No. 3 and Final in the amount of $68,925.77 to Egan
Company for the traffic signals at Schmidt Lake Road and Fernbrook Lane, Schmidt
Lake Road and Cheshire Parkway, and Schmidt Lake Road and Nathan Lane is
hereby approved and the Administrative Services Director is hereby authorized
and directed to pay the same forthwith.
4. Funding for this project will be from the following sources: developer contribution
in the amount of $371,238.00, the Street Reconstruction Fund in the amount of
$93,017.75, and the Municipal State Aid Fund in the amount of $554,715.18.
APPROVED by the City Council on this 9th day of August, 2016.
