HomeMy WebLinkAboutCity Council Resolution 2016-185 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-185 R ESOLUTION A PPROVING P RELIMINARY P LAT FOR “S UMMERS E DGE P HASE II” FOR P ROPERTY L OCATED AT AND N EAR 4240 B ROCKTON L ANE N ORTH (2016012) WHEREAS, Summergate Companies has requested approval of a preliminary plat for the roughly 27-acre parcel presently legally described as: Lot 1, Block 1, Busch Properties North, Hennepin County, Minnesota. And, the south 287.70 feet of the northwest quarter of the northwest quarter of Section 18, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request for a preliminary plat at a duly called public hearing and recommends approval; and, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Summergate Companies for a preliminary plat for “Summers Edge Phase II”, subject to the following conditions: 1. A preliminary plat is approved to allow the property to be subdivided into 52 lots for single- family homes, in accordance with the application and plans received by the city on February 11, March 25, and April 5, 2016, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site to RSF-3 and the wetland replacement plan. 3. Prior to recording the final plat, the applicant shall: 1) receive city approval of final construction plans; 2) execute a development contract and submit related fees and financial guarantees; and 3) remove all the existing buildings and fences. 4. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Submit HOA documents or covenants that include the following: 1) Assigning maintenance of common improvements including the wetland buffer, wetland buffer monuments, sidewalks, mailboxes, retaining walls, subdivision signs, etc. 2) Disclosure indicating that the nearby greenhouses are used year-round and the agricultural use may produce noise, odor or lights related to the growing operation and that the heating method requires the grinding of trees into wood chips. 3) The future use of Lot 17, Block 2 if/when the amenity lot is no longer desired by the homeowners’ association. Submit separate disclosures for the first purchasers indicating that the greenhouses are used year-round and the agricultural use may produce noise, odor or lights related to the growing operation and that the heating method requires the grinding of trees into wood chips. c. Submit fire flow calculations with each phase of the development and provide the total square footage of the largest proposed structure. d. Submit an executed, 10-foot trail easement adjacent to the right-of-way for Brockton Lane. e. Submit an executed, temporary construction easement for the off-site improvements and a permanent drainage and utility easement for the pond. st f. Submit executed temporary turnaround easements for the ends of 41 Avenue and Zircon Avenue. g. Revise the plans as follows: 1) Amend the plan sheets to be consistent with the exhibit submitted on April 5, 2016. 2) Add a pedestrian ramp entrance for Lot 7, Block 1. st 3) Add a sidewalk along 41 Place. 4) Add wetland buffer monuments along the edge of the wetland buffers consistent with section 21670.07 of the zoning ordinance. 5) Revise the landscaping plan to increase the size of the red oak to 2.5 caliper inches and provide the 1,213 inches required for restitution or pay restitution into the city’s tree fund. 6) Add a hydrant on the east side of Zircon Lane near the property line between Lots 6 and 7, Block 3. 7) Add the high water elevation for all ponds and wetlands. 8) Revise the lowest floor elevation of all homes abutting ponds and wetland to be two feet above the high water elevation. st 9) Add a right-turn lane into the subdivision at 41 Avenue. th 10) Remove the center island from the 40 Place cul-de-sac. 11) Revise the front yard lot elevations for Block 1, Lots 1-4 and 6 to reduce the front yard slope to no greater than 10 percent. 12) Revise the plat to increase the drainage and utility easements for Lot 10, Block 2 and Lot 1, Block 3 to 10 feet on either side of the storm sewer main. stnd 13) Revise the street name for 41 Place to be 42 Avenue North. 5. No retaining walls are permitted in the trail easement. 6. No driveway access to Brockton Lane shall be permitted. 7. A geotechnical report to address wetland fill shall be provided in conjunction with the building permit submittal for the homes on Lots 8 and 9 of Block 3, as shown on the preliminary plat. The report shall be prepared by a certified engineer licensed by the State of Minnesota. 8. Prior to the issuance of a building permit, the applicant shall submit a survey indicating: a. A minimum of two front yard trees to be preserved or planted. Resolution No. 2016-185 File 2016012 Page 3 b. Silt fence and tree preservation fencing installed consistent with city code. 9. Standard Conditions: a. No building permits shall be issued until the final plat, easements, and other recordable documents are filed and recorded with Hennepin County. b. Development standards and setbacks for this plat shall comply with the RSF-3 zoning standards. No variances are granted or implied. c. All retaining walls over four feet shall require issuance of a building permit and a three- foot fence installed on top of the wall. d. Compliance with the city’s tree preservation regulations. e. No trees shall be planted in the public right-of-way. f. Signs shall require a separate permit and comply with section 21155 of the zoning ordinance. g. Removal of all hazardous trees from the property at the owner's expense. h. This approval shall expire one year after the date of approval, unless the applicant has submitted a complete final plat application, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 510 of city code.
