HomeMy WebLinkAboutCity Council Resolution 2016-174 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-174 R ESOLUTION A PPROVING A C ONDITIONAL U SE P ERMIT TO I NSTALL E IGHT-F OOT F ENCING FOR P ROPERTY L OCATED AT 2400 X ENIUM L ANE N ORTH (2016029) WHEREAS, Christopher and Banks has requested approval of a conditional use permit for the site located at 2400 Xenium Lane North, legally described as follows: Parcel 1: The West 695.89 feet of that part of the North Half of the Northeast Quarter of Section 27, Township 118, Range 22, lying South of the North 300.5 feet thereof, lying North of a line parallel with and 759.71 feet North of the South line of Block One Minneapolis Industrial Park, and lying East of the Northerly extension of the West line of said Block One; except that part platted as nd Minneapolis Industrial Park 2 Addition. And That part of the West 695.89 feet of that North Half of the Northeast Quarter, Section 27, Township 118, Range 22, lying East of the Northerly extension of the West line of Block 1, Minneapolis Industrial Park, lying South of a line parallel with and 759.71 feet North of the South line of said Block 1 and lying North of a line described as follows: Beginning at a point in the South line of Lot Four, Block One, Minneapolis Industrial Park, distant 39.43 feet West of the Southeast corner thereof; thence North 4 degrees 36 minutes 20 seconds West 300.21 feet; thence Northeasterly 182.13 feet along a tangential curve to the right having a radius of 399.26 feet; thence North 21 degrees 31 minutes 50 seconds East tangent to the last described curve to the point of intersection with the North line of said Lot Four; thence Northeasterly along the last described tangent line to a point distant 215.74 feet from its point of tangency; thence Northeasterly 24.83 feet along a tangential curve to the left having a radius of 419.26 feet, said curve being designated as “curve A”; thence North 88 degrees 43 minutes 40 seconds East along a line parallel with the South line of said Block One; and lying east of the continuation northeasterly of the above designate “curve A” to the point of intersection with a line parallel with and distance 759.71 feet north of the south line of Block 1, Minneapolis Industrial Park. Parcel 2: Non-exclusive easement for railroad right-of-way purposes as described in Warranty Deed dated March 27, 1973, filed June 18, 1973, as Document No. 4022758.; and Resolution 2016-174 File 2016029 Page 2 WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Christopher and Banks for a conditional use permit to install eight-foot fencing in the side and rear yards of the property located at 2400 Xenium Lane North, subject to the following conditions: 1. The requested conditional use permit is approved to allow the installation of eight-foot fencing in the side and rear yards of the property, in accordance with the application and plans received by the city on April 13, 2016 and additional information on April 15, 2016, except as amended by this resolution. 2. The requested conditional use permit is approved with the finding that the applicable conditional use permit standards would be met. 3. Prior to installation of the fencing, the applicant must obtain separate approval of a building permit. Prior to issuance of the building permit, the applicant shall fulfill the requirements and submit the following required information: a. Plans that demonstrate the drive aisle with the gates in the full open position would be a minimum of 20 feet in width. b. Fire department approved details on the gate operation. 4. Standard Conditions: a. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. b. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
