R ESOLUTION N O. 2016-169
A PPROVING R E-A SSIGNMENT OF D EVELOPMENT C ONTRACTS FOR
THE B RYNWOOD D EVELOPMENT (2013095, 2015027, AND 2015095)
WHEREAS, K. Hovnanian Homes and D.R. Horton Homes have requested re-assignment of the

development contracts for Brynwood and Brynwood 2 via an “Assignment of Development Contract”.
WHEREAS, K. Hovnanian Homes and D.R. Horton Homes have requested amendment to the
rd
approved, but not yet signed or recorded, development contract for Brynwood 3 Addition to change
the name of the Developer on Pp. 1 and 13 from K. Hovnanian to D.R. Horton.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve re-assignment of the development contracts for
the Brynwood development.
FURTHER, the Mayor and Manager are hereby authorized to sign the “Assignment of
nd
Development Contract” for Brynwood and Brynwood 2 Addition on behalf of the City, upon prior
execution by the Developer and Successor Developer.
FURTHER, Pp. 1 and 13 of the approved, but not yet signed or recorded, development contract
rd
for Brynwood 3 Addition is hereby amended to change the name of the Developer from K. Hovnanian
to D.R. Horton.
