HomeMy WebLinkAboutCity Council Resolution 2016-159 C ITY O F P LYMOUTH RESOLUTION NO. 2016-159 R ESOLUTION A PPROVING F INDINGS OF F ACT FOR THE R EZONING OF L AND LOCATED AT AND NEAR 5635 Y UCCA L ANE (2016009) WHEREAS, Pulte Homes of Minnesota has requested reclassification of the zoning from P-I (public/institutional) and FRD (future restricted development) to PUD (planned unit development) for roughly 70 acres located at and near 5635 Yucca Lane; and WHEREAS, the affected property is presently legally described as follows: The North 660 of the West 330 feet of the Northwest Quarter of the Southwest Quarter of Section 3, Township 118 North, Range 22, Hennepin County, Minnesota. AND That part of the Northwest Quarter of the Southwest Quarter lying East of the West 330 feet thereof, and that part of the West 330 feet of the Northwest Quarter of the Southwest Quarter lying South of the North 660 feet thereof, all in Section 3, Township 118, Range 22, Hennepin County, Minnesota. AND That part of the North Half of the Southeast Quarter of the Southwest Quarter of Section 3, Township 118, Range 22, Hennepin County, Minnesota, lying West of the Westerly right-of-way line of Interstate Highway Number 494 as described in Book 3514 of Mortgages, Page 374, Hennepin County records. EXCEPT that part of the South 30 feet of the East 700 feet of the North Half of the Southeast Quarter of the Southwest Quarter, in Section 3, Township 118, Range 22, Hennepin County, Minnesota, which lies Westerly of a line drawn parallel with and 40 feet Westerly of the Westerly right-of-way line of Interstate Highway Number 494. AND That part of the South Half of the Northeast Quarter of the Southwest Quarter of Section 3, Township 118, Range 22, Hennepin County, Minnesota, lying West of the Westerly right-of-way line of Interstate Highway Number 494 as described in Book 3514 of Mortgages, Page 374, Hennepin County records. AND Outlot B, Glacier Vista, Hennepin County, Minnesota. Resolution 2016-159 (2016009) Page 2 WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval; and WHEREAS, the City Council has adopted an ordinance rezoning the affected land from P-I and FRD to PUD. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request for reclassification of the zoning from P-I and FRD to PUD for roughly 70 acres legally described above, based on the following findings: 1. The requested PUD zoning is consistent with LA-2 guiding. 2. The proposed density and development plan is consistent with LA-2 guiding. 3. The proposed development and lot arrangement would comply with the requested PUD. 4. Adequate infrastructure would be available to support the proposed development.
