HomeMy WebLinkAboutCity Council Resolution 2016-156 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-156 R ESOLUTION A PPROVING A C ONDITIONAL U SE P ERMIT FOR D AVRON G AFUROV FOR L IMITED M OTOR V EHICLES S ALES AT 14050 23 RD A VENUE (2016 019) WHEREAS, Davron Gafurov has requested approval of a conditional use permit to allow limited motor vehicle sales in the I-2 (general industrial) zoning district for property legally described as follows: That part of the Southeast Quarter of the Northwest Quarter of the Northwest Quarter of Section 27, Township 118, Range 22 lying West of US Highway No. 494, except road, and subject to transmission line easement, together with vacated Cheshire Lane, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Davron Gafurov for a conditional use permit for limited motor vehicle sales, subject to the following conditions: 1. A conditional use permit is approved to allow limited motor vehicle sales within a 2,029 rd square foot lease space in the I-2 zoning district, at 14050 23 Avenue, in accordance with the application received by the city on March 7, 2016, except as may be amended by this resolution, and with the finding that the proposed use would comply with the applicable conditional use permit standards. 2. A separate building permit is required prior to commencement of the use. The lease space to be used for limited motor vehicles sales shall comply with all building and fire codes. A flammable waste trap is required for the existing floor drain within the lease space area. 3. Prior to commencement of the use, the applicant shall obtain the required motor vehicle sales license from the State of Minnesota. 4. The use shall comply with the following specific conditions of approval as listed in Section 21565.07, Subd. 12 of the zoning ordinance: a. There shall be no outside storage or display of vehicles for sale or lease. b. Not more than five vehicles for sale or lease shall be on the premises at any given time. c. Signage related to motor vehicle sales or leasing shall be limited to 24 square feet. d. No temporary signage/advertising devises (e.g., portable signage, banners, pennants, spotlights, skytrackers, inflatables, balloons) shall be allowed. Resolution 2016-156 File 2016019 Page 2 5. Standard Conditions: a. Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. b. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. c. Violations of the conditions of approval may result in revocation of the conditional use permit. d. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
