HomeMy WebLinkAboutHousing & Redevelopment Authority Minutes 09-10-1986MINUTES OF PRE -TERMINATION HEARING HOUSING AND REDEVELOPMENT AUTHORITY OF PLYMOUTH, MINNESOTA SEPTEMBER 10, 1986 The pre -termination hearing of the Housing and Redevelopment Authority of Plymouth, Minnesota was called to order by Chairman Del Erickson on the 10th day of September, 1986 at 6:10 p.m. in the Large Conference Room at the City of Plymouth, Minnesota. The following members of the Authority were present: Chairman Erickson, Commissioners Gerry Neils, Harold Bakke, Rod Hillstrom and David Crain. Also present was: Paul Rasmussen, Attorney from the law firm of Lefevre, Lefler and Housing Specialist Milt Dale. ABSENT None FIRST HEARING: Bryan Santwire (Certificate No. 24M, Apartment 1069 10121 Highway SS. The only person present was Valerie Santwire who indicated her husband Bryan was working late and could not be present. Staff gave a brief summary of the incidents that led to the scheduling of the hearing and updated the Commissioners on some new information relative to the police report. and the income verification data provided by Bryan's employer, Gary Santwire, on Wednesday morning, September 10th. Staff stated that one of the police calls indicated on the readout from the Police Department should be purged as it was mistakenly placed in the computer. Valerie Santwire indicated she had quit her job almost three months ago. She also stated that the disturbances at the apartment came about due to another tenant who has had several arguments with her husband Bryan. She stated that at this time Bryan no longer secs this individual. She admitted that they should have responded to staff's request for income verification for Bryan sooner. She did make mention that the secretary for Gary Santwire failed to mail the report to City HaIL. A letter from Gary Santwire to staff indicated that the secretary left her job a few days later and her oversight was not discovered until recently. Commissioners Neils, Bakke and Chairman Erickson stressed to Valerie Santwire the Importance of prompt compliance with Section 8 regulations relative to verifying income data and other information requested by staff. Commissioner Neils also warned Valerie that it would be very difficult for their family to obtain a Section 8 Certificate in another community due to long waiting lists in other communities should the Santwires lose their Section 8 certificate in Plymouth. The Commissioners discussed the Santwire situation in terms of the recent submittal of the income verification data for Bryan Santwire and the failure of the apartment management to attend the hearing. Staff was asked If the apartment manager indicated whether there were plans to evict the Santwires due to the disruptive ac.ivlties at the complex. Housing Specialist Dale stated he did not believe this was their Intention at this time. 0 HRA Minutes of September 109, 1986 Hearing Page two MOTION was made by Commissioner Rod Hillstrom that the Santwires should be given a warning that any future failure to comply with Section 8 .regulations would result in a termination of their Section 8 Certificate in Plymouth. MOTION carried, five ayes. Valerie Santwire was directed to provide a statement from her employer indicating she had been terminated from her job. It was requested that this information be provided to staff within one week. SECOND HEARING: Sherryl Condon Hawks. (Certifico__ No. 43F2, Apartment 129, 3301 County Road 18. Staff gave a brief review of the Sherryl Condon Hawks situation. Staff indicated that Sherryl and her boyfriend, Ross Togerson, had moved out on the weekend of September 6th without giving any notice to the manager. Staff Inspected the apartment on Monday, September 8, 1986 and found it in a "devastated" condition, i.e. closet doors pulled off the runners, two kitchen cabinet drawers removed from the premises, the refrigerator half full of food, cigarette butts piled on the kitchen counter and litter on the floors. MOTION was made by Commissioner Hillstrom, seconded by Commissioner Crain, to terminate the Section 8 certificate for Sherryl Condon Hawks as of September 10, '1986. NOTION carried, five aye^. is Staff was further directed to send a notice to her last known address with the request it he forwarded to her new address. Commissioners discussed the time and date for the next Housing Authority meeting. It was agreed to hold the next meeting on Thursday, September 25, 1986 at City Hall. Staff indicated. that a letter and Annual Contributions Contract to continue the Section 8 Program in Plymouth through September 30, 1989 had been received from the HUD Area Office. Staff had recommended not signing those contracts until the City Council, at its budget hearings, indicated whether there was a preference to continue the Section 8 Program in Plymouth or discontinue the program beyond the scheduled termination date of September 30, 1987. Commissioners directed staff to provide a cost breakdown of the Section 8 Program in terms of the administrative fee provided by the federal government versus the actual administrative cost in terms of salaries and other related expenses incurred to administer the program. Also, staff was directed to survey the Plymouth apartment managers and owners to determine if they would prefer to have the program administered locally or through some other office such as the Metro Housing and Redevelopment Authority.
