SUBJECT: Section. 8 and Rehab progress `Report
Staff received a tetter Friday, May 13, 1977, from the HUD Area Director's office
approving the Plymouth HRA's operating budget for the fiscal year endin June 30,
1978. Total amount to be funded over this period is anticipated to be 179,,044.
Following is a breakdown of how this money is to be used over the next 13+ months:
Housing Assistance Payments (Money to go to apartment

Administrative and Preliminary Administrative Expense's

Staff still is awaiting the submission of a final ACC ( Annual Contributions Contract)
from HUD. HUD staff has indicated this document would be forthcoming in -one to two
weeks. Upon the signing of this contract, staff may then sign up those apartment
owners in Plymouth whose rents are below fair market rents. After this has been
accomplished, applications will be processed and eligible applicants may select an
apartment unit of their choice.
The lengthy delays involved in the Section 8 program has been disheartening but un-
fortunately this appears to be the rule rather than the exception with many of HUD's
programs. I did receive communication from Senator Humphrey in this regard and I have
enclosed the letter for informational purposes. Perhaps his involvement helped the
HUD "turtle" wiggle a little faster.
The Plymouth Housing Rehabilitation Committee has ap-eed to a. set of guidelines and
eligibility requirements for the City's Home Improv ant Grant Program. Also as a
part of this Guideline is a section relating to inspections (See page 10) and criteria
for emergency funding (See page 10 and 1.1). The City Building Inspector will be at
the May 23rd meeting to respond to questions relative to this section. A resolution
is attached regarding the funding of emergency home improvements.

At,ached is a Status Report of M.H.F.A. Home.Improvement Projects Funded and
Proposed as of May 17. 1977. Staff has conferred with the Metro Council HRA
staff regarding the possibility of receiving any additional money to complete
a proposed basement water -proofing project. It appears there is a good chance
this additional money will be forthcoming.

Suoma Designation of a Depository for HRA Funds and Check Cashing Procedures
It is necessary that the Plymouth HRA designate a depository for Section 8 monies.
These funds shall be utilized primarily for the payment to apartment owners on a
monthly basis as per Section 8 guidelines. The anticipated dispurseme.nt of the
Section 8 monies over the next 13+ months is shown in the Memo titled Section 8
and Rehab Progress. -Report. Staff recommends the designation of the Plymou—`tai mate.
ank f -or -this purpose. A resolution to this effect is attached.
In conferring with the City's attorney it was determined that it is necessary that
the HRA have its own separate bank account necessitating a separate checking account
from that of the City's account. Accordingly the HRA's Bylaws will require the
signatures of the HRA's Sectetary-Treasurer, Gerry Neils, and HRA's Chairman, Al
Hilde, Jr., to be on each check. It is suggested that disbursements from this fund
follow the same procedures as presently utilized for all other City funds. The
normal procedure is for the Finance Department to prepare the checks, affix a
facsimile signature of the authorized signatures and mail the checks. As the checks
are prepared a listing is also printed and later forwarded to the governing body for
their review. The signing of the checks by the H'tA's Executive Director is reviewed
by the Finance Department prior to their dispursement.

BYLAWS OF THE HOUSING AND REDEVELOPMENT AUTHORITY
OF PLYMOUTH, MINNESOTA
ARTICLE I - THE. AUTHORITY.
Section 1. Name. of Authority. The name of the Authority sha;l be the

Section 2. Seal of Authorit . The seat of the Authority shall be in the
form of a circle an shall. ear the name of the Authority and the year of its
organization.
Section 3. Office of Author__i,!_X. The offices of the Authority shall be
at City Hall in thi City of Plymouth, State of Minnesota, but the Authority
may hold its meetings at such other place or places as it may designate by
resolution.
ARTICLE Il - OFFICERS
Section 1. Officers. The officers of the Authority shall be a Chairman,
a Vice -Chairman, and a Secretary -Treasurer.
Section 2. Chairman. The Chairman shall preside at all meetings of the
Authority. Except as of erwise authorized by resRlutioa of the Authority, the
Chairman shall sign all contracts, deeds and ziher instruments made by the
Authority. At each meeting the Chairmar shall submit such recommendations
and information as he may consider rzaper concerning the business, affairs
and policies of the Authority.
Section 3. Vice -Chairman. The Vice -Chairman shall perform the duties
of the Chairman inthe a sence or incapacity of the Chairman; and in case of
the resignation or death of the Chairman, the Vice -Chairman shall perform such
duties as are imposed on the Chairman until such time as the Authority shall
select a new Chairman.
Section 4. Secretar. -Treasurer. The Secretary -Treasurer shall perform
the duties of a Secretary for the Authority and shall sign all orders and
checks for the payment of money and shall pay out and disburse such moneys
under the direction of the Authority. Except as otherwise authorized by
resolution of the Authority, all such orders and checks shall be counter-
signed by the Chairman.
Section 5. Executive Director. The Authority may employ an Executive
Director who shall have genera supervision over the administration of its
business and affairs, subject to the direction of the Authority. He shall
be charged with the management of the housing projects of the Authority.,
As assistant to the Secretary -Tree surer, the Executive Director in his
own name and title shall keep the records of the Authority, shall act as
Secretary of the meetings of the Authority and record all votes, and shall
keep a record of the proceedings of the Authority in a journal of proceedings
to be kept for such purpose, and shall perform all duties incident to his
office. He shall keep in safe custooy the seal of the Authority and shall
have power to affix such seal to all contracts and instruments authorized
to be executed by the Authority.

He shalt have the care and custody of all funds of the Authority and
shall deposit the same in the name of the Authority in such bank or banks
as the Authority may select. He shall keep regular books of accounts showing
receipts and expenditures and shall render to the Authority, at each regular
meeting or oftener when requested), an account of his transactions and also
of the financial condition of the Authority. He shall give such bond for the
faithful performance of his duties as the Authority may determine.
The compensation of the Executive Director shall be determined by theAuthority.
Section 6. Additional Duties. The officers of the Authority shall
perform such other duties and functions as may from time to time be required
by the. Authority or the bylaws or rules and regulations of the Authority.
Section 7. Election or Appointment. The first Chairman shalt, pursuant
to his appointment, serve In the capacity of Chairman until the expiration of
his term of office as Commissioner. The Vice -Chairman, Secretary -Treasurer
and, except in the case of the First Chairman, the Chairman shall be elected
at the annual meeting of the Authority from among the Commissioners of the
Authority, and shall hold office for one year or until their successors are
elected and qualified.
The Executive Director shall be appointed by the Authori y. Any person
appointed to fill the office of Executive Director, or any vacancy therein,
shall have such term as the Authority fixes, but no Commissioner of the
Authority shall be eligible to this office.
Section 8. Vacancies. Should the office of Chairman, Vice -Chairman
or Secretary -Treasurer become vacant, the Authority shall elect a successor
from its membership at the next regular meeting, and such election shall be
for the unexpired term, of said office. When the office of Executive Director
becomes vacant, the Authority shall appoint a successor, as aforesaid.
Section 9. Additional Personnel. The Authority may from time to time
employ such personnel as it diems necessary to exercise its powers, duties
and functions as prescribed by the Municipal Housing and Redevelopment. Law
of Minnesota applicable thereto. The selection and compensation of such
personnel (including. the Executive Director) shall be determined by the
Authority subject to the laws of the State of Minnesota.
ARTICLE III - MEETINGS
Section 1. Annual Meetin . The annual meeting of the Authority shallbeheldonthefourtondayofJanuaryat7:30 o'clock p.m. at the regular
meeting place of the Authority..

Euclosed is a copy of HUD -52673, Estimate of Required. Annual
Contributions, and supporting forms HUD -52671 and 52672 which
have been, approved for your fiscal year ending Jwie 30, 1978.
The administrative fee has been increased to reflect the
increase in face market rent which will became effective very
shortly. Utility allowance has been reduced eliminating the
allowance for air conditioning. HUD 52663, Requisition for
funds may be submitted immediately for the June and September
quarters. You must also send in a HUD 274 despository agreem
Operations must be conducted within the amounts budgeted for
each account. Revisions made to requested amounts were dis-
cussed with you prior to change. The budgev forms may be
revised during the fiscal year if it becomes apparent changes
are necessary within the limitations contained in the instructions
for these forms.
