HomeMy WebLinkAboutCity Council Resolution 2016-146 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-146 R ESOLUTION A PPROVING C ONDITIONAL U SE P ERMIT FOR A D AYCARE/P RESCHOOL FOR P ROPERTY L OCATED AT 3200 H ARBOR L ANE (2016 017) WHEREAS, Yellow Brick Road Child Care, Inc. has requested approval of a conditional use permit to allow a daycare/preschool in the existing building and related site improvements for property located at 3200 Harbor Lane North and legally described as follows: The south 166 feet of Lot 3, Block 2, Fox Meadows First Addition, subject to and together with a non-exclusive easement for ingress and egress over the north 24 feet of the south 178 feet of said Lot 3, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Yellow Brick Road Child Care, Inc. for a conditional use permit for a daycare/preschool, subject to the following conditions: 1. A conditional use permit is approved to allow the existing building to be used as a daycare/preschool and related site improvements, in accordance with the plans received by the city on February 26 and April 7, 2016, except as amended by this resolution, with the finding that the proposal complies with all applicable conditional use permit standards. 2. A separate building permit is required prior to commencement of the project. 3. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit the required information, and revise the plans as indicated below, consistent with the applicable city code, zoning ordinance, and engineering guidelines: a. Execute a site improvement and performance agreement and submit related financial guarantees and fees. b. Receive approval of final construction plans. c. Revise the plans to indicate: 1) B6/12 curb and gutter around the east and south sides of the modified parking area and 2) an enclosure adequately sized for all waste containers consistent with section 21120 of the zoning ordinance. 4. The daycare/preschool shall remain in compliance with Minnesota State licensing requirements. 5. Fire lane signage shall be installed in locations to be field identified by the fire inspector. Resolution 2016-146 File 2016017 Page 2 6. Standard Conditions: a. No variances are granted or implied. b. Any rooftop equipment shall be screened consistent with section 21130.05 of the zoning ordinance. c. Any signage shall comply with section 21155 of the zoning ordinance and shall receive sign permits if required. d. Any subsequent phases or expansions are subject to required reviews and approvals per ordinance provisions. e. The conditional use permit shall expire one year after the date of approval, unless the property owner or applicant has started the project, or unless the applicant, with the consent of the property owner, has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under section 21015.07 of the zoning ordinance.
