R ESOLUTION A PPROVING A S ITE P LAN AND C ONDITIONAL U SE P ERMIT FOR
S ENIOR A PARTMENT B UILDING ON P ROPERTY L OCATED E AST OF THE I NTERSECTION OF
S TATE H IGHWAY 55 AND O LD R OCKFORD R OAD (2016 008)
WHEREAS, United Properties has requested approval of a site plan and conditional use permit to
allow construction of a senior apartment building for the property presently legally described as follows:
That part of the east half of the east half of the southwest quarter lying north of State Highway
No. 55 and south of the centerline of Hennepin County Road No. 9 Section 7, Township 118,
Range 22 and that part of the east half of the northeast quarter of the northwest quarter of
Section 18, Township 118, Range 22, lying north of State Highway 55, Hennepin County,
Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA, that it should and hereby does approve the request by United Properties for a site plan
and conditional use permit for a senior apartment building, subject to the following conditions:
1. A site plan is approved to allow construction of a senior apartment building and related site
improvements, in accordance with the plans received by the city on January 25 and March
11, 2016, except as amended by this resolution.
2. A conditional use permit is approved to allow a building to exceed 35 feet in the O district
with the finding that the proposal complies with all applicable conditional use permit
standards.
3. Approval of the site plan and conditional use permit is contingent upon approval of the
rezoning and wetland mitigation plan.
4. A separate building permit is required prior to commencement of the project.
5. Prior to issuance of the building permit, the applicant shall remove the existing billboard.
6. Prior to issuance of the building permit, the applicant shall fulfill the requirements, submit
the required information, and revise the plans as indicated below, consistent with the
applicable city code, zoning ordinance, and engineering guidelines:
a. Execute a site improvement performance agreement and submit the related financial
guarantees and fees pursuant to section 21045.10 of the zoning ordinance.

b. Obtain any required permits from MnDOT and the watershed district.
c. Execute and record drainage and utility easements over the proposed storm sewer.
d. Execute and record a public right-of-way easement as indicated on the site plan.
e. Execute and record a maintenance agreement over the filtration basin.
f. Execute and record an encroachment agreement for the retaining wall located in a
drainage and utility easement.
g. Vacate the unnecessary existing drainage and utility easement over the wetland.
h. Submit fire flow calculations.
i. Obtain city approval of final construction plans.
j. Revise the plans as follows:
i. Amend the lighting plan or submit fixture details identifying the CRI rating for the CC
fixture.
ii. Amend the lighting plan to include the FF and GG fixtures or remove them from the
building elevations. Amend the lumens per square foot calculation as may be
necessary.
iii. Amend the landscaping plan to substitute other species for the Colorado blue
spruce and parkway Norway maples. Consider oak species (crimson spire or regal
prince) instead of the maple and either ponderosa or scotch pines instead of the
blue spruce.
iv. Specify three inches of trim around the windows.
v. Relocate hydrants to approved locations.
vi. Indicate surmountable curbs at the entrances to the fire lane.
vii. Add a solenoid valve and post indicator valve in approved locations.
viii. Add turning radius evaluations from the west fire lane to the site main entry drive
and around the main entry island.
7. Silt fence shall be installed prior to any construction on the site.
8. Fire lane signage shall be provided in locations to be field identified by the fire inspector.
9. The applicant shall coordinate construction and access to the site with the project manager
for the Old Rockford Road mill and overlay project.
10. The emergency generator shall require separate review and approval via an administrative
permit prior to its installation.
11. Standard Conditions:
a. The applicant shall remove any diseased or hazardous trees.
b. No trees may be planted in the public right-of-way.
c. Any rooftop/ground-mounted equipment shall be screened consistent with the
requirements of section 21130.05 of the zoning ordinance to match the building.
d. Compliance with the city’s lighting regulations.
e. Any signage shall comply with section 21155 of the zoning ordinance and shall receive
sign permits if required.

f. Any subsequent phases or expansions are subject to required reviews and approvals per
ordinance provisions.
g. The site plan and conditional use permit shall expire one year after the date of approval,
unless the property owner or applicant has started the project, or unless the applicant,
with the consent of the property owner, has received prior approval from the city to
extend the expiration date for up to one additional year, as regulated under sections
21045.09 and 21015.07, respectively, of the zoning ordinance.
