HomeMy WebLinkAboutCity Council Resolution 2016-123 C ITY OF P LYMOUTH R ESOLUTION N O. 2016-123 R ESOLUTION A PPROVING F INDINGS OF F ACT AND D ECISION FOR A PPEAL BY T IERRA K IRSTIN J ACKSON-C AMPBELL OF D ENIAL OF 2016 M ASSAGE T HERAPIST C ERTIFICATE ______________________________________________________________________________ IN RE: FINDINGS OF FACT AND DECISION Appeal by Tierra Kirstin Jackson-Campbell of Denial of Massage Therapist Certificate ______________________________________________________________________________ On April 12 and April 26, 2016, the Plymouth City Council met at its regularly scheduled meetings to consider Tierra Kirstin Jackson-Campbell’s appeal of the denial of her massage therapist certificate. Tierra Kirstin Jackson-Campbell was present and the City Council heard testimony from all interested persons wishing to speak. FINDINGS OF FACT 1. On February 8, 2016, Tierra Kirstin Jackson-Campbell submitted an application for a Massage Therapist Certificate to the City. 2. The application was referred to the Plymouth Police Department for the Department’s review and recommendation. The Police Department was unable to complete the background investigation due to inaccuracy with her Minnesota identification card as the middle name on the card was spelled “Kristin.” The address on the Minnesota identification card also did not match the address provided on her application. Therefore, she was requested to update her Minnesota identification card and resubmit the application. On February 18, 2016, she resubmitted her application and attached a copy of the Minnesota identification card application that corrected the spelling of her middle name (Kristin) and the address so it matched the address given on the massage therapy application. The Police Department conducted a background investigation and recommended that the Certificate be denied. 3. On March 1, 2016, the City Manager denied Tierra Kirstin Jackson-Campbell’s application for a Massage Therapist Certificate because she did not disclose her addresses for the past five years and because she falsified her application by not disclosing information regarding her criminal convictions: 1  Disorderly conduct charge on March 18, 2012 in Kansas. Pled guilty on March 20, 2012.  Two counts of burglary (entered dwellings to commit felony, theft, or sexual battery) for incident on July 13, 2012 in Kansas. Sentenced on November 5, 2012. She received probation and violated terms of probation. Warrant issued – only applies to surrounding states.  Providing false name for incident on September 27, 2013 in Minnesota. Pled guilty on May 21, 2014. 4. Tierra Kirstin Jackson-Campbell appealed the City Manager’s denial of her application for a Massage Therapist Certificate to the City Council. 5. Plymouth City Code § 1135.13 provides: Conditions Governing Issuance. A Certificates may be issued only to persons of good repute. B. Certificates may be issued only to persons who have answered fully all of the information requested in the application. 6. Tierra Kirstin Jackson-Campbell did not answer fully the information requested in the application. She did not provide the addresses of her residences within the past five years and she did not disclose her prior criminal convictions. 7. Tierra Kirstin Jackson-Campbell is not a person of good repute. She falsified her application for a Massage Therapist Certificate and has three criminal convictions. DECISION The City Manager’s decision denying a 2016 Massage Therapist Certificate to Tierra Kirstin Jackson-Campbell is affirmed. Approved by the City Council this 26th day of April, 2016. 2
