Charman David Crain on June 16, 1994.

deadline to apply is July 1, 1994.
Commissioner McFabnd questioned if there are any advautzges to sMybg separately from
Metro HRA.
Housing Secretary Ho responded by administering the RAPS Program independently you
earn up to $40.00 administrative fee per participant.
Director Hadburt commented that tine spent administering the program could use up the fee
rather guichly.
Commissioner Eden believed at this time it mats sense to join Metro EMA for this program.

contractor will not commit to an occupancy date as of yd, but should by July 1. At this time,

Chairman Crain asked V building and fire code issues have been resolved.
Mr. OppgW nplled the majority of outstanding issues have been resolved. There an a few
small issues to be worioed out yet, but on a project this size, it is typical to have some
outstsnding issues.
Chairman Crain gmdoned if the remaining issues are maoagable and is the project still
within budget and concept design.
Mr. Oppegatd responded the issues remaining are interpretation problems v it6 phunbiog and

Dona Flub of Waller Mamgemam poesomed a Monthly Occupancy Report for Myth
Towne Square as of June 16. She informed Commissioners that Sarah Miller, the apartment
maoW, has sat up 60 appohmants for the neon two weeks and will begin offering units by
July 1. Walker will require a 5100.00 deposit to bold a unit, which will be cradhod toward
their damage deposit.
Ms. Planta was ooncemed with questions she has received from dens asking If the building
would change to mndoet no in the near fatun. She o!%nd to nslay a statement to all
intended parties that it is the intention of the housing authority that Plymouth Towne Square
will remain subsidined.
Chairman Crain and Commission Edson consumed that Waller Maosparant should relay to
residents that Plymouth Towne Square is a subsidized project and will remain so.
Director Hudburt assured Commissioners she would be informing staff' pe aoanel of this so

The purpose of this Plea Is to establish a process In the City which mum adeque0e oppormables for

are residents of slum and blighted areas, and of areas in which funds aro proposed to be used,
and provides for participation of mMem in low and moderate income neighborhoods as

Payments in`1lLieu of Taxes
I have reviewed the two Memoranda prepared by Liz Elder attheHennepinCountyAttorney's office regarding the property taxstatusofthePlymouthHousingandRedevelopmentAuthority'sSeniorHousingproject, and I have spoken with Me. Elder on thetelephonetoconfirmherposition. She agreed with our positionthattheAuthority's Project constitutes a"housing developmentproject" as defined in Minnesota Statutes, Section 469.002, Subd. 15, and that under Minnesota Statutes, Section 469.040, Subd. i is exempt from all real and personal property taxes oftheCity, the County, the State or any political subdivisionthereof.
However, Minnesota Statutes, Section 469.040 goes on toprovideinSubd. 3 that the Project is subject to a •servicecharge" or payment in lieu of taxes° equal to five percent (SO) of aggregate shelter rentals each year. This subdivision definesthetermshelterrentalstomean the total rentals of a housingdevelopment] project exclusive of any charge for utilities andspecialservicessuchasheat, water, electricity, gas, sewagedisposal, or garbage removal." Therefore the Authority shouldcalculateeachyearthetotalshelterrentalspaidbyyourtenants (regardless of income) with the exclusions describedabove, and also excluding any other non -shelter related charges, such as garage rents or any fees paid for programs or services attheproject, and pay five percent (50) of such amount to theHennepinCountyDirectorofPropertyTaxationasyourservicecharge.
Section 469.040, Subd. 3 states that this *service charges
shall be collected from the Authority in the manner provided bylawfortheassessmentandcollectionoftaxes, which would meanthattheservicechargepayableinanyyearwouldbebasedontheshelterrental: for the prior year. Although the Authority couldarguethatthisreferencewouldallowtheAuthoritytopayitsservicechargeintwoequalinstallmentsonorbeforeMay15thandOctober15thitis -the. customary practice of other housingauthoritiesandIwouldrecommendthatyoupaytheentireservice
Charge in one installment by May 15th. After receiving thisservicechargetheCountywillredistributeittothevarioustaxingjurisdictions (including the City of Plymouth) in the sameProportionastheirregulartaxrates.
You should also note that if you sublet a portion of theProjectforaprivatecommercialactivity (e.g.: a beauty shoporfoodservice) you may subject that portion of the project .toregularcommerctiaipropertytaxes. j

As yon are aware, since December, 1993, we have been
discussing with the City of Plymouth the issue of the City's
expenditure of CDBG funds. we had indicated that the City must
take additional steps to increase the rate of expenditures.
In February, 1994, we indicated that by November 1, 1994,
Plymouth will need to have no more than $445,500 in its Line of
Credit (LOC). We further indicated that Plymoutb will need to draw
357,4399.08 from its LOC before then to seat this bench mark. On
March 15, you submitted to us a plan which e; 'Led how Plymouth
would be able to make the necessary expenditu. .
July lot was the half -way point in the time frame covered in
this plan (March 1, to November 1). Therefore, it seems
appropriate to now evaluate the City's performance against the
plan's projections. Theplan projected that by June 31, the City
would draw $308,564 from its LOC. Since March 1 the City has, in
contrast, drawn $162,669.53 from its LOC. This amount is only
52.70 of the projected amount to be drawn. In addition it is 45.41
of the amount that is necessary to be drawn by November 1.
Thus, the City must draw an additional $194,769.53 from its
LOC in the second half of the timerframn. This In a 19.71 increase
in the rate of draw doors. It appears that the City suet takestepstoImproveitsexpendituresoritwillnotmeetthedrawdown
bench marks. We do not have sufficient information to determine
Which of the City's projects are not progressing as quickly as hadbeenprojected. Bwaver, we suggest that the City analyze its
projects and determine :whether or not it needs to take anyaddtionalactionsinordertomoraitsprojectsforwardina
timely manner.
We remind the City that a failure to Beet the bench mark
requirements by November 1, .1994, may result in a contract
condition on the 1995 CDBG award. The condition would likely
require the timely expenditure of funds during the 1995 programyear. If the requirements of such a condition were not met, the

CDBG funds in the LOC would be reduced by the amount of funds that
were in excess of the bench marks.
We are hopeful that the City will be able to take whatever
steps are necessary to avoid such a contract condition. If you

REPRESENTATIONS AND WARRANTIES OF THE PARTES
A. The City of Plymouth renm:sents that it is a municipal oorpomtion of the State of .
Minnesota authorized to eater into this agreement by Minnesota Statute. Section 463.151.
B. Amie Dam Wesala and Corrine A. Wesala (hereafter the 'Owmers'), waraut
they are the sole owners of the Property, and that on the date of their signature to this
agreement, the title to the Property is subject only to the following exceptions:
i. covenants, conditions, restrictions, declarations and easements of record,
if any;
ii. reservations of minerals or mineral rights by the State of Minnesota, if
any;
iii. building, =dug and subdivision laws and regulations;
iv. unpaid taxes and special assessments;
V. Mortgage, to Twin City Federal Savings and Loan Association (hereafter
Mortgagee'), dated December 16, 1983, filed January 25. 1984 as
Document No. 1359429.
C. The Owners have received a claim of some ownership interest in the -Property
from Russell F. Almquist and Constance A. Almquist. however. the Owners have and do deny
mch claim in that no documents agreeing to the Rale or transfer of the Property have been
executed by both Owners.
D. The Owners and Mortgagee represent that the condition of the buildings on the
Property meets the definition of 'hazardous building or harardous Property" as defined by
Minnesota Statutes 1463. 15, Subd. 3.

Meetings are held the second and fourth Wednesdays of the month at 7:00 p.m. in the
Council Chambers of the City Center. A Public Forum is held the first meeting of the
month at 6:45 p.m. Members are appointed for three-year terms expiring January 31stofthatyear. The Chair and Vice Chair shall be appointed by the Commission and
confirmed by the Mayor from among the members of the Commission and shall serveforatermofoneyear.

The annual meeting of the Housing Authority shall be held in January at the regular
meeting place of the Authority.
Regular meetings of the Housing Authority shall be held on the third Tuesday of each
month commencing at 7:00 p.m. The Authority may cancel any regular meeting other
than the annual meeting.
Members are appointed for five-year terms expiring the end of January or until a new
commissioner has been selected as a replacement. Chair, Vice. Clair, and Secretary are
appointed by the Authority.
