R ESOLUTION N O. 2016-067
R ESOLUTION A CCEPTING S TREETS FOR C ONTINUAL M AINTENANCE
FOR O’D ONNELL W OODS A DDITION (2012099)
WHEREAS, in accordance with the development contract dated January 22, 2013, T Creek 3 Inc.,
developer of O’Donnell Woods Addition (2012099), has agreed to install certain improvements for said
development; and
WHEREAS, the developer has completed a portion of the street, utility and site grading as noted
below; and
WHEREAS, the developer has requested a reduction of the required financial guarantee to
reflect the completed work.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA; that the financial guarantee requirements are reduced as follows below and that the
required financial guarantee and Letter of Credit No. 249 for the items be reduced from $189,493 to
$78,857:

BE IT FURTHER RESOLVED that the streets are accepted for continuous maintenance as of March
8, 2016, subject to the one-year guarantee by the Developer per Letter of Credit No. 249.
APPROVED by the City Council on this 8th day of March, 2016.
