At the July 22, 2014 City Council study session, the City Council directed staff to prepare a report
analyzing rental licensing as it pertains to short term vacation renting (VRBO – Vacation Rental By
Owner) and place the item on the October 14, 2014 study session agenda.
VRBO’s are more prevalent in other parts of the country than they seem to be in Plymouth and
surrounding communities. Until earlier this summer, staff had not heard of any properties in Plymouth
being rented on a short term basis (short term being defined for this discussion as a few days to a few
weeks) for either vacation purposes or other short term purposes. This summer, a resident inquired
about a property located on the south side of Bass Lake that was being rented as a vacation property
website information attached). Once staff was notified about the property, staff contacted the owner
of the property and indicated that what they were doing was not in violation of the current rental
licensing ordinance, except they needed to apply for the license and pass an inspection. The owner has
applied for the license, the initial inspection was completed and the re-inspection was performed on
September 19th, but did not pass. A re-inspection has been scheduled for December 1, 2014 and the
property cannot be rented again until it passes inspection (the owners are currently living at the
property).
The concerns raised, and to some extent experienced, are the number of cars parked on the driveway
during rental periods, the noise coming from the back patio, pool and lake later in the evening and the
general not knowing who or when someone would be at the property. These concerns are different
than general rental concerns because the renters are very short term and short term renters do not
have the same expectations of being part of the neighborhood as other renters generally do.
Staff has discussed short-term rental with representatives from Minnetonka, Maple Grove and Lakeville.
Minnetonka – Minnetonka does not have a rental licensing ordinance. They know of properties
being rented on a short term basis but have chosen not to regulate them.
Maple Grove – Maple Grove has a rental licensing ordinance. They have not currently had any
issues with short-term rental, do not know of any properties that are being rented on a short-
term basis, nor do they have anything in their ordinance that would prevent it.
Lakeville – Lakeville does not have a rental licensing ordinance. However, earlier this year they
amended their zoning ordinance to stipulate that the minimum term for renting of rooms is
thirty (30) days.

Staff is looking for direction from the City Council on how to proceed: 1) do nothing, 2) bring forward an
amendment that would stipulate a minimum lease period, or 3) bring forward an amendment that
includes other proposed changes.

Item: Set Future Study Sessions
Staff is recommending the Council schedule and/or add the following items to scheduled study sessions:
Schedule annual board and commission interviews on December 2 at 6 p.m. so appointments can
be made at the December 9 meeting. Applications are being accepted until November 7. Staff is
notifying current committee and commission members whose terms are expiring to determine if
they want to be considered for reappointment, and those materials will be provided to the Council
in the very near future.
Schedule a Study Session on November 25 prior to the Regular Council Meeting to discuss economic
development funding and to receive an update on the risk management fund.
Add to the Budget Study Session agenda on October 28, a report on major capital reserve funds.
Council should also review the list of pending study sessions below and set meetings as desired. Calendars
are attached to assist with scheduling.
