WHEREAS, the Building Official for the City of Plymouth has attempted without success to have the
owner of certain property remedy the hazardous and unsafe conditions of the real property, uninhabitable
house and detached garage situated on property at 617 Cottonwood Lane North, Plymouth, Minnesota,
located in the County of Hennepin (“Subject Property”); and
WHEREAS, the City Council has determined that the buildings and conditions of the real property on
the Subject Property constitute a hazardous condition and are a health and safety hazard within the
meaning of Minn. Stat. § 463.15, subd. 3.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH,
MINNESOTA:
1.The City has fully considered all evidence relating to the code violations at the Subject
Property. Said evidence includes (i) a Property Report indicating ownership of the Subject
Property; (ii) an Inspector’s Report regarding the Subject Property which was executed on
October 5, 2015; (iii) a letter dated October 12, 2015 from the City of Plymouth’s Housing
Inspector to the property owner stating the numerous hazardous conditions and City
Code violations requiring immediate attention; and (iv) additional photographs taken and
date stamped 10/05/2015.
2.After fully considering all of the reports, photographs, documents, and other evidence
pertaining to the code violations at the Subject Property, the City of Plymouth finds:
a.A.N.T.S. LLC is the owner of the Subject Property and Americana Community
Bank has a lien on the property. There are no unsatisfied judgments on the
Subject Property.
b.The City of Plymouth notified the owner of the code violations on October 12,
2015. No permits have been issued for repairs and no visual improvements have
been made to the Subject Property.
c.The Subject Property, which is located in Hennepin County, contains hazards to
public health and safety and is therefore a Hazardous Property within the meaning
of Minn. Stat. § 463.15, subd. 3.
d.The Subject Property is unsecured because doors and windows have been
removed or broken.
e.The roof of the Subject Property is in poor condition, and contains worn and
missing shingles. The exterior walls of the Subject Property have not been
maintained in good repair. The siding is missing in areas, the paint is peeling,
and sections of the wood on the exterior walls have rotted away.
f.The interior of the Subject Property is deteriorating and has not been
maintained in good repair. The interior of the Subject Property has damaged
and missing floor coverings, damaged sheetrock consisting of large holes in the
walls, and large holes in the interior ceilings resulting in insulation materials
falling into rooms.
g.There is significant damage to the interior of the Subject Property probably due
to vandalism.
h.There is also a large accumulation of debris and rubbish on the Subject Property
including appliances, scrap lumber, concrete blocks, remains of an addition that
was attached to the garage, and other miscellaneous rubbish.
i.The furnace, water heater, plumbing fixtures, kitchen fixtures, and appliances
have been removed from the Subject Property. The bathroom fixtures have
been damaged or destroyed.
j.The detached garage on the Subject Property is in a dilapidated condition and is
open for trespass. The siding on the garage is rotted and missing, the roof is in
poor condition, and there is a large accumulation of rubbish within and around
the garage.
3.Pursuant to Minnesota Statutes § 463.16 et seq., the City hereby adopts and approves the
Order for Repair and Removal of Hazardous Conditions of the Real Property and Buildings
located on the Subject Property attached hereto as Exhibit A.
4.The City’s legal counsel, Campbell Knutson, P.A., Grand Oak Office Center I, 860 Blue
Gentian Road, Suite 290, Eagan, Minnesota 55121, is directed to serve the Order for Repair
and Removal of Hazardous Conditions of the Real Property and Buildings and to proceed
with enforcement in accordance with Minn. Stat. § 463.15 et seq.
