HomeMy WebLinkAboutCity Council Resolution 2010-277CITY OF PLYMOUTH RESOLUTION No. 2010-277 A RESOLUTION APPROVING A HOME OCCUPATION LICENSE FOR LAURA HARDING TO OPERATE A PIANO STUDIO OUT OF THE HOME LOCATED AT 4855 EVERGREEN LANE NORTH (2010074) WHEREAS, Laura Harding has requested a home occupation license to operate a piano studio from her home at 4855 Evergreen Lane North, legally described as follows: Lot 16, Block 1, Zachary Hills 4th Addition, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public meeting and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Laura Harding for a home occupation license at 4855 Evergreen Lane North, subject to the following conditions: 1. The home occupation license is approved for a piano studio in accordance with the application and plans received by the City on August 9, 2010, except as amended by this resolution. 2. Compliance with section 21145 of the zoning ordinance, relating to home occupations. 3. Staff finds that the applicant meets the general standards for home occupations and the specific requirements for home occupation licenses. Specifically, staff finds: a) The home occupation would be clearly incidental and secondary to the residential use of the premises, would not change the residential character of the neighborhood, and would not result in a disturbance to the surrounding uses. b) There would be no use of equipment that would cause electrical interference to surrounding properties. c) The applicant would use her driveway and not more than two spaces on -street to accommodate parking demand. d) There would not be exterior storage of equipment used in the home occupation. e) Less than 25 percent of one story of the home would be used for the home occupation. Resolution 2010-277 2010074 Page 2 f) No person other than those who reside in the home would be employed on the premises. 5. The home occupation license is valid for one year from the date of approval. The applicant may apply to the zoning administrator for renewal of the home occupation license prior to expiration of the license. ADOPTED by the City Council on October 12, 2010.
