RESOLUTION NO. 2010-276
A RESOLUTION APPROVING REQUEST FOR PAYMENT NO. 2
AND FINAL CITY PROJECT NO. 10010
WHEREAS, the City of Plymouth as owner and Pearson Bros., Inc., as contractor, have
entered into an agreement for the 2010 Seal Coat Program, said agreement being dated April 13,
2010; and
WHEREAS, the City Engineer has certified his acceptance of the work and his approval of
the final request for payment.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA:
1. That the original contract amount was $340,862.75 and the value of the work to date is
$287,532.38 and is herewith approved.
2. That the work performed by the contractor for the 2010 Seal Coat Program and
certified to the Council by the City Engineer as acceptable, being the same, is hereby
released from the contract except as to the conditions of the performance bond, any
and all legal rights of the owner, required guarantees and correction of faulty work
after final payment.
3. Request for Payment No. 2 and Final in the amount of $14,376.62 to Pearson Bros.,
Inc. for the 2010 Seal Coat Program, City Project No. 10010. Is hereby approved and
the Director of Administrative Services is hereby authorized and directed to pay the
same forthwith.
4. Funding for this project shall be as follows:
Street Maintenance (100-70-710-71000-7500.109) $331,128.07
Park Maintenance (100-40-411-41100-7500.109) $17,290.00
