RESOLUTION No. 2010-247
A RESOLUTION AUTHORIZING THE VACATION FOR PART OF A
PLATTED DRAINAGE AND UTILITY EASEMENT LOCATED AT 4283 EVERGREEN LANE
WHEREAS, a public hearing with respect to said vacation was scheduled for August 24, 2010 in
accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and
WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to
the meeting of August 24, 2010; and
WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and
WHEREAS, the City Council extended the public hearing to September 14, 2010 to inform any
and all interested parties relevant to the vacation of the existing easement; and
WHEREAS, Xcel Energy, Qwest and CenterPoint Energy have no conflict with vacating the
proposed easement.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
PLYMOUTH, MINNESOTA: That the following drainage and utility easement be vacated:
All that part of a platted drainage and utility easement within Lot 3, Block 1, Forster
Preserve Plat 4; except the northerly, southerly and westerly 6 feet, lying west of the
following described line:
Commencing at the northwest corner of said Lot 3; thence easterly along the north line of
said Lot 3, a distance of 28.62 feet to the point of beginning of said described line; thence
southerly to a point on the south line a distance of 36.12 feet easterly of the southwest
corner of said Lot 3 and said line there terminating.
FURTHER, that said vacation shall not affect the authority of any person, corporation, or
municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm
sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or there under, to continue
maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace,
remove, or otherwise attend thereof.
