A RESOLUTION APPROVING A FINAL PLAT AND DEVELOPMENT CONTRACT FOR PULTE
HOMES FOR "THE WILLOWS" FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF
JUNEAU LANE AND COUNTY ROAD 47 (2010041 F)
WHEREAS, Pulte Homes of Minnesota has requested approval of a final plat for roughly 28
acres of land presently legally described as follows:
The North 295.95 feet of the West 716 feet of the South 626.40 feet of the West '/z of the
Northeast '/4 of Section 4, Township 118, North Range 22, West of the 5th Principal
Meridian, Hennepin County, Minnesota. Also that part of the North 330.45 feet of the
South 660.90 feet of the West '/z of the Northeast '/4 lying East of the West 716.0 feet
thereof, in Section 4, Township 118, Range 22.

WHEREAS, the city staff has prepared a development contract covering the improvements
related to said plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Pulte Home of Minnesota for a final plat for The Willows; and,
FURTHER, that the development contract for said plat be approved, and that upon prior
execution of the development contract by the developer, the mayor and city manager be
authorized to execute the development on behalf of the city; and,
FURTHER, that the following conditions be met prior to recording of, and related to said plat;
1. A final plat is approved for the creation of 24 single-family lots and four outlots for The
Willows, in accordance with the plat and plans received by the city on July 29, 2010 and
August 19, 2010, except as may be amended by this resolution.

2. Prior to impacting any wetlands or proceeding with grading, the applicant shall install
tree preservation fencing and silt fencing and request inspections.
3. Prior to recording the final plat, the applicant shall pay park dedication in lieu of land
dedication, in accordance with the dedication ordinance in effect at the time the final plat is
approved.
4. Prior to recording the final plat, the applicant shall remove all strictures except the home
and any outbuildings proposed to be entirely on Lot 1, Block 3. Separate permits are
required.
5. Prior to recording the final plat, the applicant shall submit the required information and
revise the plans as indicated below consistent with the city code, zoning ordinance and
engineering guidelines as may be applicable:
a. Assessments/easements/agreements/permit requirements:
1) Pay the following assessments: a) sanitary sewer in the amount of $11,495 and b)
water in the amount of $42,652.50.
2) Submit the deed for Outlot A.
3) Dedicate Juneau Lane right-of-way south of 59th Avenue with 22.43 feet of right-
of-way from the existing centerline. The easterly plat boundary shall be tied to the
center line of the traveled roadway for Juneau Lane.
4) Provide the street names on the plat.
5) Execute an unobstructed access easement as a separate document for maintenance
of the pond and the sanitary sewer manholes outside rights of way. The accesses
must be 15 feet wide and have a slope of less than ten percent with a 12 -foot wide
driving surface capable of supporting maintenance equipment.
6) Submit written authorization from adjacent property owners to plant trees on their
property.
7) Execute an encroachment agreement to allow plantings, to be maintained by the
Homeowner's Association, in the right-of-way along County Road 47 and 60th
Avenue.
8) Execute an encroachment agreement for retaining walls that cross into drainage and
utility easements on Lots 3-7 Block 1, Lots 6-8, 10-15, Block 2 and Lot 1, Block 3.
The applicant shall minimize the walls in the drainage and utility easements to the
extent possible.
9) Execute a maintenance agreement for the rain garden.
10) Submit disclosure documents notifying potential buyers about the city's intent to
close Juneau Lane when Cheshire Parkway is extended to County Road 47 and that
the property to the east is proposed to be developed with the Trillium Woods
project.
11)Revise the HOA documents as follows: 1) include Exhibit D which defines the
responsibility for maintaining retaining walls that cross property lines, 2) add a
graphic identifying the landscape easement area as the landscaping along County

Road 47, 3) state that the HOA will be responsible for the wetland buffers and
wetland buffer monuments, and 4) define where the conservation easement area is
located on the property or remove the language referring to the conservation
easement.
12) Permits as follows: MPCA (sanitary sewer extension); Department of Health
(water main extension and well abandonment); Elm Creek and Shingle Creek
Watershed District; NPDES; Hennepin County (abandonment of onsite sewage
systems, directional boring of watermain and street connection to County Road 47,
work in the county road right-of-way); and City of Plymouth for building removal
and work in Juneau Lane right-of-way.
b. Revise the grading, water resources plan, and erosion control plan to:
1) Add an additional wetland buffer monument at the end of the retaining wall on Lot
3 Block 1.
2) Consider applying for a LOMR or LOMA to alter the floodmap for the lots affected
by the special flood hazard zone A designation (lots 3-7, block 1).
3) Revise the other plan sheets to be consistent with the trail location on the south side
of the pond as shown on the grading plan.
4) Show the trail connection from Niagara Lane to the existing pond access on city
property. Revise the location of the retaining wall along Niagara Lane as necessary
to accommodate the location of the planned connection with the Northwest
Greenway and consistent with the existing gravel path.
5) Identify drainage swale slopes and the drainage direction in the rear yard areas in
Block 2.
6) Erosion control blanket is required on a113:1 slopes in Block 1.
7) Erosion control silt fence is required around the rain garden and along the north side
of the storm water pond.
8) Identify an interim pond access route.
9) Provide a detail and cross section for the concrete overflow channel. The trail
profile in this area must meet ADA requirements.
10) Show a planting schedule for the rain garden.
11) If soil compaction occurs in the rain garden area, soil shall be scarified to a depth of
36 inches prior to constriction of the rain garden.
12) Identify a concrete trick washout area.
c.Revise the street and utility plans as follows:
1) Add an additional watermain connection in County Road 47 to provide adequate
flow and pressure or provide a ten -inch watermain in Niagara Lane to the
intersection with 60th and 59th Avenues and an eight -inch internally looped
watermain as an alternative to the second connection.
2) If an eight -inch main is to be used, confirm the proposed 8 -inch water main
connection to the existing 20 -inch water main in County Road 47 will satisfy fire
flow requirements for the development by submitting fire flow calculations for the
entire development and the first phase of the development flowing the two highest
elevation remote hydrants simultaneously. Each hydrant must flow 1500 gallons per
minute at 20 psi residual pressure.

3) Match pipe inverts in sanitary sewer manhole 3.
4) Provide a 20 -foot length of ductile iron pipe for the outside drop at sanitary sewer
manhole 2.
5) Use polyvinyl chloride (PVC SDR 26) for sanitary sewer between manholes 1 and 2
and between manholes 2 and 6.
6) Lower the water services on the south side of 59th Avenue between catch basins 124
and 127 to avoid interference with the storm sewer lines. Insulation may also be
required.
7) Identify street names on utility plans.
8) Include the updated version of city standard plate W-1 for sewer and water services.
9) Match the street vertical curve lengths shown on the previously -approved grading
plan.
10) Identify and install type 3 barricades (two each) at the east end of 59th Avenue and
60th Avenue.
11) Install three street name signs at the intersection of Niagara Lane with 59th Avenue
and 601h Avenue.
12) Identify and install the following signs:
a) A 15 mph curve sign (Type WI -2 and W131-1) on westbound Niagara Lane
approximately 200 feet east of the street curve.
b) A one -direction arrow sign (Type W1-6) in the curve for eastbound Niagara
Lane.
c) A "Keep Right' (Type R4-7) and object marker (Type OM1 -2) signs on each
end of the median island in Niagara Lane.
d) "No Parking" (Type R7-1) on both sides of the Niagara Lane curve.
13) Constrict concrete median noses in accordance with City Standard Plate STRT-5.
14) Provide a concrete pedestrian ramp on the west side of Niagara Lane at County
Road 47.
15) Signing and striping on County Road 47 shall be modified to convert the eastbound
bypass lane to a right turn lane at Niagara Lane.
16) Match pipe inverts in catch basin 102 and for east and west pipe runs in catch basin
127.
17) Install 14 cubic yards of Class 3 rip rap and a trash guard at the end of flared end
section 128.
18) Tie all pipe joints on both ends of outlet control stricture 200.
d. Revise the tree preservation/inventory/landscaping plan as follows:
1) Indicate trees 107-111 as removed, alter the calculations and amend the
landscaping plan as necessary to accommodate the additional restitution.
2) Substitute other conifers for Black Hills spruce to reduce the dominance on this
specie; use no more than 100 trees of any one specie.
3) Show the wetland buffers for the adjacent Taryn Hills development on the plans
and relocate proposed trees outside wetland buffers.
4) In the landscaping plan to allow for the trail connection, indicate a 20 -foot gap in
the landscaping in the location shown for the connection with the northwest
greenway corridor near the Niagara Lane trail segment.

5) Show the location of the required interpretive signs along the optional loop of the
northwest greenway as required to allow trails within wetland buffers.
6) Submit a design for the interpretive signs for the trail segment proposed in the
wetland buffer.
6. The sidewalks along all local streets and the optional loop of the northwest greenway shall
be installed at the same time as the streets and utilities.
7. No permits shall be issued for Lots 1 and 16, Block 2 until the turnarounds are removed and
the roads extended with the second phase.
8. The home at 5835 Juneau Lane must be connected to city sewer and water with this
development. The connections may occur with the second phase.
9. Setbacks for this development shall comply with the RSF-3 zoning standards; no variances
are approved or implied.
10. No driveway access shall be permitted to County Road 47.
11. All lowest floor elevations shall be a minimum of two feet higher than the calculated 100 -
year high water elevation of adjacent ponds or wetlands. Additionally, the lowest building
opening where storm water may enter (door or window) shall be a minimum of 18 inches
higher than the overland overflow.
12. Standard Conditions:
a. No building permits shall be issued until the final plat, the HOA documents, all
easements, and agreements are filed and recorded with Hennepin County and proof of
recording is submitted to the city.
b. Any signage shall comply with the city's signage regulations.
c. Building permits are required for retaining walls 48 inches in height or higher.
Additionally, a fence shall be installed at the top of retaining walls that exceed four feet
in height.
d. Compliance with the city's tree preservation regulations. Should field adjustments to the
tree preservation fencing result in additional impact, the impact shall require review as
outlined in section 530.19 of the city code.
e. Removal of all hazardous trees from the property at the owner's expense.
f. This approval shall expire two years after the date of approval, unless the property owner
or applicant has recorded the final plat with Hennepin County, or unless the landowner or
applicant has received prior approval from the city to extend the expiration date for up to
one additional year, as regulated under section 512 of city code.
