HomeMy WebLinkAboutCity Council Resolution 2010-231CITY OF PLYMOUTH RESOLUTION No. 2010-231 A RESOLUTION APPROVING A PUD GENERAL PLAN FOR STEEPLE HILL ON PROPERTY LOCATED AT VICKSBURG LANE AND COUNTY ROAD 47 (2010052) WHEREAS, DR Horton and Plymouth Housing Group LLC. have requested approval of a PUD general plan for the property legally described as follows: The east half of the northeast quarter, also the east 20 acres of the west half of the northeast quarter; all in Section 5, Township 118, Range 22 west, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA that it should and hereby does approve the request by DR Horton and Plymouth Housing Group for a PUD general plan, subject to the following conditions: 1. A PUD general plan amendment is approved to allow 37 single-family dwellings and an apartment building with a minimum of 67 dwellings, according to the plans received by the city on May 28 and July 1, 6, 9 and 13, 2010, except as amended by this resolution. 2. Approval of this PUD general plan is contingent on approval of the rezoning, preliminary plat and wetland mitigation plan. 3. Development standards shall be as indicated on the plans and materials dated May 28 and July 1, 6, 9 and 13, 2010, except as amended by this resolution. 4. Parking may be provided at two spaces per apartment unit. No recreational vehicles, except motorcycles and bicycles, shall be stored on the property. 5. The apartment building is approved with a height of 53 feet (as defined by the zoning ordinance), based on the reduced height of the building on the south and east wings and the increased setbacks from Vicksburg Lane and the north property line. 6. The following setbacks shall apply to the single family lots: a. A 25 -foot building setback measured from the rights-of-way of all local streets. b. A 25 -foot rear building setback. c. An eight -foot side -yard building setback for living area and a six-foot garage setback (regardless of living area above or behind). Resolution 2010-231 File 2010052 Page 2 d. A 15 -foot stricture setback from the wetland buffers, except that uncovered decks and at - grade patios may be located up to nine feet from the wetland buffer and retaining walls are permitted within the setback to the wetland buffer. e. A 50 -foot building setback from the County Road 47 right-of-way. f. No buildings or strictures shall be constricted within drainage and utility easements without the approval of the city engineer. g. Other strictures and improvements shall be reviewed consistent with Section 21115.04 of the zoning ordinance. 7. Setbacks for the apartment building shall be as shown on the plans dated July 6, 2010, however a 15 -foot setback from the wetland buffer shall apply. 8. No building permits shall be issued until a PUD final plan is approved by city staff. 9. With the PUD final plan application, the applicant shall submit the following consistent with the city code and the zoning ordinance: a) Specifications for the fence to be installed on the top of the retaining wall along County Road 47. b) A revised lighting plan, including fixture details, consistent with the cut-off requirements, watts per square foot, shielding and fixture height. 10. Prior to issuance of a building permit for the single-family homes, the applicant shall submit the following plans and materials: a) A certified survey for each lot that includes the location, size and specie of the two required overstory trees to be planted in the front yards. b) Any retaining walls to be installed on the property or on the property lines must be shown on the survey. No installation of retaining walls shall be permitted in drainage and utility easements without approval of an encroachment agreement. 11. All signage shall require separate permits and shall be in conformance with section 21155 in the zoning ordinance. APPROVED THIS 24TH DAY OF AUGUST, 2010.
