RESOLUTION No. 2010-230
A RESOLUTION APPROVING A PRELIMINARY PLAT FOR "STEEPLE HILL" FOR PROPERTY
LOCATED AT VICKSBURG LANE AND COUNTY ROAD 47 (2010052)
WHEREAS, DR Horton and Plymouth Housing Group, LLC have requested approval of
a preliminary plat for 38 lots on the roughly 18 -acre parcel of land located at Vicksburg Lane
and County Road 47;
WHEREAS, the property is presently legally described as follows:
The east half of the northeast quarter, also the east 20 acres of the west half of the
northeast quarter; all in Section 5, Township 118, Range 22 west, Hennepin County,
Minnesota.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by DR Horton and Plymouth Housing Group LLC. for a preliminary plat for
Steeple Hill, subject to the following conditions.
1. Approval of this preliminary plat is contingent on approval of the rezoning.
2. A preliminary plat is approved for the creation of 37 lots for single-family homes and one
lot for an apartment building, in accordance with the plat and plans received by the city on
May 28 and July 1 and 9, 2010, except as may be amended by this resolution.
3. Prior to impacting any trees or wetlands or proceeding with grading, the applicant shall
install and request inspections of tree preservation fencing and silt fencing.
4. This approval waives the secondary access requirement for 61" Avenue, based on the
potential opportunity to extend the stub street to County Road 47.
5. With the final plat application or prior to recording the final plat (as may be
applicable), the applicant shall fulfill the requirements, submit the required information, and
revise the plans as indicated below, consistent with the applicable city code, zoning
ordinance, and engineering guidelines:
a. Assessment/easement/agreement/permit requirements:
(1) Payment of sewer and watermain area charges in the amount required at the time
the final plat is approved.
(2) Standard drainage and utility easements to be shown on the plat: 1) six feet from
side and rear property lines; and 2) 10 feet from public rights-of-way.

(3) A 20 -foot drainage and utility easement to be shown on the plat centered on all
public utilities outside the public right-of-way.
(4) Dedication of right-of-way for local streets shall be 50 feet, 60 feet for County
Road 47 adjacent to single-family lots, 70 feet for County Road 47 adjacent to the
multiple family lot and 33 feet for Vicksburg Lane.
(5) Provide a street, drainage and utility easement for the temporary turn -around on
the west end of 61" Avenue.
(6) Show existing drainage and utility easements on the abutting property to the
north, if any exist.
(7) Temporary easements may be required for grading on private property for the
eastbound bypass lane on County Road 47.
(8) Provide an unobstructed access easement for maintenance of the pond. The access
must be 15 feet wide and have a slope of less than 10 percent with a 12 -foot wide
driving surface capable of supporting maintenance equipment.
(9) Drainage and utility easements need to be shown on the plat over all ponds,
wetlands and wetland mitigation areas to the 100 -year high water elevation. and
over the infiltration basins.
(10) An encroachment agreement is required for the retaining wall in the drainage and
utility easements for Lots 18 and 24, Block 1.
(11) Submit disclosures to be provided to homeowners regarding: 1) the temporary
nature of the stub street; 2) the property to the west is owned by the school
district; and 3) the east side of the property is to be developed with apartments.
(12) Submit homeowner association documents and assign responsibility to the HOA
for the sidewalks, retaining walls that cross property lines, and maintenance of the
wetland buffer and buffer monuments.
(13) A maintenance agreement shall be required for the infiltration basins.
(14) Required permits: MPCA for sanitary sewer main extension; Minnesota
Department of Health for water main extension and well abandonment; Elm
Creek Watershed District; NPDES; Hennepin County for abandonment of on-site
sewage system(s) and work within the County Road 47 right-of-way; City of
Plymouth for work in the Vicksburg Lane right-of-way and removal of buildings;
and City of Maple Grove for connection to sanitary sewer.
b. Tree preservation and landscaping plans:
(1) Revise plans as necessary to be consistent with the revised inventory submitted
July 13, 2010.
(2) Add signage by the tot lot noting it is for "Resident Use Only" to prevent
trespassing by others.
(3) Consider adding a low fence or landscaping around the tot lot to provide
separation between the play area and the vehicle traffic.
(4) Should field adjustments to the tree preservation fencing result in additional
impact, the impact shall require review as outlined in Section 530.19 of the city
code.

c. Grading and erosion control plans:
(1) Erosion control and details must be shown on plans, including silt fence, rock
constriction entrance, inlet protection and erosion control blanket on 3:1 slopes
and greater. Identify inlet protection for the existing culvert along Vicksburg
Lane.
(2) Demonstrate that drainage swales have minimum 1.75 % grades.
(3) The proposed retaining wall along County Road 47 shall be placed outside the
right of way. The use of large modular block for the retaining wall is
recommended. A detail must be provided that shows the relationship between the
wall and the existing culvert under County Road 47.
(4) Trail grades in several locations along County Road 47 exceed the maximum
grade of 5% allowed by ADA standards.
(5) Demonstrate how trees adjacent to the north property line will be protected during
sanitary sewer constriction.
d. Street and utility plans:
(1) Submit fire flow calculations flowing the two remote highest elevations hydrants
simultaneously. Each hydrant must flow a minimum 1500 gallon per million at
20 pounds per square inch residual pressure.
(2) Identify the proposed barriers for the emergency access to County Road 47.
Collapsible bollards are recommended for the emergency access off County Road
47.
(3) Include the most current approved details and standards as shown in the
engineering guidelines.
(4) Plan and profile sheets will be required for all streets and utilities. All details
shown need to be per current Plymouth engineering guidelines.
(5) Proposed curb for Weston Lane shall terminate at the edge of the required right
turn lane on County Road 47, not the edge of the travel lane as shown.
(6) Confirm that the proposed signing and striping for the turn lanes and bypass lanes
on County Road 47 meet County requirements.
(7) Pedestrian ramps are required at all locations where sidewalks and trails intersect
with public streets.
(8) Tie all joints of storm sewer pipes between strictures and flared end sections.
(9) Storm sewer note 5 shall reference "Standard Detail Specifications" instead of
"Engineering Guidelines"
(10) Utility note 5 shall identify high density polyethylene pipe for water services.
(11) The watermain along County Road 47 shall be placed a minimum of 10 feet from
the proposed retaining wall.
(12) Call out the existing 16 inch watermain and show all existing gate valve locations
on Vicksburg Lane.

(13) The sanitary sewer crossing of the proposed storm sewer north of Wetland 1 may
require insulation.
(14) Constrict a new manhole at the connection to the Maple Grove sewer.
(15) Add note on utility plan to contact the city of Maple Grove before making a
connection to the sanitary sewer.
(16) Maintain the existing drainage along Vicksburg Lane while constricting the
sanitary sewer.
e. Water resource plan:
(1) Indicate concrete trick washout areas.
(2) Submit drainage calculations that demonstrate compliance with
requirements for total suspended solids, phosphorus, volume, and rate
control for all areas draining to the pond.
(3) A SWPPP plan needs to be submitted and shown with final constriction
plans.
(4) Relocate proposed trees outside the wetland buffer areas.
(5) Furnish cross section details and planting plans for infiltration basins.
6. Prior to recording the final plat, the applicants shall remove the riding arena
encroachment over the property line.
7. The trail along County Road 47 between Yuma and Vicksburg Lane shall be completed with
the second phase. The trail shall include curb cuts at intersections and/or driveway
crossings.
8. Standard Conditions:
a. No building permits shall be issued until the final plat, the HOA documents, all
easements and agreements are filed and recorded with Hennepin County and proof of
recording is submitted to the city.
b. No building permits shall be issued until buffer and conservation easement monuments
are installed.
c. The lowest floor elevation for all strictures are required to be a minimum of two feet
above the adjacent water bodies. In addition, there must be a minimum of 18 inches of
freeboard between the lowest building opening where storm water may enter (doors or
windows) and the designated emergency overland overflow.
d. Any signage shall comply with the city's sign regulations.
e. Building permits are required for retaining walls 48 inches in height or higher.
Additionally, a fence with a minimum height of three feet shall be installed at the top of
retaining walls that exceed four feet in height.
f. Retaining walls in drainage and utility easements should be avoided where possible.

g. Removal of all hazardous trees from the property at the owner's expense.
h. This approval shall expire two years after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the city to extend the expiration date for up
to one additional year, as regulated under Section 510 of city code.
