HomeMy WebLinkAboutCity Council Resolution 2010-226CITY OF PLYMOUTH RESOLUTION NO. 2010-226 A RESOLUTION APPROVING AN INTERIM USE PERMIT FOR HAMPTON HILLS INVESTMENT, LLC, FOR PROPERTY LOCATED AT 5313 JUNEAU LANE NORTH (2010068) WHEREAS, Hampton Hills Investment, LLC has requested approval of an interim use permit to allow grading operations at the fiiture Hampton Hills subdivision, located on the former Hampton Hills golf course site for property legally described as follows: Tract A, Registered Land Survey No. 1618, except that part thereof which lies easterly and northerly of the following described line: Commencing at the Northwest corner of said Tract A; thence on an assumed bearing of South 89 degrees 55 minutes 03 seconds East along the Northerly line of said Tract A a distance of 430.00 feet to the point of beginning of the line to be described; thence South 17 degrees 02 minutes 42 seconds East a distance of 408.70 feet; thence on a bearing of East to the East line of said Tract A and said line there terminating. Tract B, Registered Land Survey 1618. That part of Government Lot 3, Section 4, Township 118, Range22, lying Southerly of Registered Land Survey No. 1618. Government Lot 1 of Section 9, Township 118, Range 22. That part of the Northeast Quarter of the Northwest Quarter of Section 9, Township 118, Range 22 described as follows: Commencing at the Northeast corner of the Northwest Quarter of Section 9; thence Westerly along the North line of said section to a point 1000 feet from said corner; thence Southwesterly to a point on the East line of the Northwest Quarter of Section 9 distant 1000 feet Southerly from the Northeast corner of said section; thence Northerly along said East line of the Northwest Quarter of Section 9, to the point of beginning. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hampton Hills Investment, LLC for an interim use permit for grading operations at 5313 Juneau Lane North, subject to the following conditions: Res. 2010-226 (File 2010068) Page 2 1. This interim use permit is approved to allow grading operations involving roughly 160,000 cubic yards of soil, in accordance with the plans received by the city on July 27, 2010, except as may be amended by this resolution. 2. Approval of this interim use permit does not approve or authorize any future platting or development layout for the site. 3. Prior to issuance of the required grading permit, the applicant shall revise the plans to indicate the following: a. Call out borrow and fill area numbers on all plan sheets. b. Provide minimum 13/4 percent slopes for swales. c. Show silt fence around entire borrow and fill areas. d. Identify impacts to trees in borrow and fill areas. e. Provide the road section that will be built for access to the existing home. f. Identify how areas will be restored after the grading. g. Provide an additional plan sheet showing the complete grading operation area. h. Demonstrate how Fill Area I will be accessed to avoid wetland impacts. 4. Prior to issuance of the required grading permit, the applicant shall provide a tabulation of the tree inches impacted by the grading operation. The impacted trees would be counted toward removal in the overall calculations for the tree preservation and reforestation plan for future platting of the subject area. 5. Access for the existing home located east of Fill Area 2 shall be maintained during the grading operation. 6. The fill shall consist of earthen material and shall not consist of garbage, animal or vegetable refuse, poisons, contaminants, chemicals, decayed material, filth, sewage or similar septic or biologically dangerous material. 7. Compliance with section 2025 (noise) of the city code. The hours for grading operations shall be limited to between 7:00 AM and 7:00 PM Mondays through Fridays, and between 8:00 AM and 6:00 PM on Saturdays. 8. The applicant shall complete all site restoration, including seeding to establish a vegetative ground cover, within six months from the date of approval of the interim use permit by the City Council, unless otherwise extended pursuant to section 21185.08 of the zoning ordinance. 9. Erosion control blankets shall be provided for slopes that are 3:1 or greater. Res. 2010-226 (File 2010068) Page 3 10. Erosion control blankets and silt fence shall be maintained until vegetative ground cover is established, as required by the city engineer. 11. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. ADOPTED by the City Council on August 24, 2010.
