RESOLUTION No. 2010-215
A RESOLUTION APPROVING FINDINGS OF FACT FOR AMENDING THE ZONING ORDINANCE
TEXT FOR THE ELM CREEK HIGHLANDS PUD, FOR PROPERTY LOCATED AT PEONY LANE AND
SCHMIDT LAKE ROAD (2010047)
WHEREAS, Alliant Engineering, has requested approval of a PUD (planned unit development)
amendment to allow site alterations and the reduction of one lot for the property located at Peony
Lane and Schmidt Lake Road, presently legally described as follows:
Lots 1-9, Block 1 Elm Creek Highlands, Hennepin County, Minnesota.
Lots 1-24, Block 1 and Lots 1-20, Block 2 and Outlot A Elm Creek Highlands Second
Addition, Hennepin County, Minnesota
WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing
and recommends approval; and
WHEREAS, the City Council has adopted an ordinance amending the zoning ordinance text.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Alliant
Engineering for site alterations and the reduction of one lot, based on the following findings:
1. The proposed development is consistent with the LA -2 land use designation on the
comprehensive plan land use guide plan map.
2. The proposed development would meet the purpose and intent of the PUD zoning district by
a) providing protection for the areas of steep slopes while producing a density that is
consistent with the direction in the comprehensive plan and b) providing opportunities for
shared regional ponding and additional local street connections.
3. There is adequate infrastructure to serve the proposed development.
