HomeMy WebLinkAboutCity Council Resolution 2010-213CITY OF PLYMOUTH RESOLUTION No. 2010-213 A RESOLUTION APPROVING A PRELIMINARY PLAT FOR ALLIANT ENGINEERING FOR "ELM CREEK HIGHLANDS EAST" FOR PROPERTY LOCATED NORTH OF SCHMIDT LAKE ROAD AND JEWEL LANE (2010048) WHEREAS, Alliant Engineering has requested approval of a preliminary plat for 31.1 acres of land presently legally described as follows: Parcel One The North 336 feet of the South 2018.6 feet of the West 672 feet of the West half of the Northwest Quarter, Section 8, Township 118, Range 22, Hennepin County, Minnesota. Torrens Property — Certificate No. 1084372 (Commitment file no. 18722) Parcel Two The North 336 feet of the South 1682.6 feet of the West 672 feet of the West half of the Northwest Quarter of Section 8, Township 118, Range 22, Hennepin County, Minnesota. Torrens Property — Certificate No. 683241 (Commitment file no. 1875 1) Res. 2010-213 File 2010048 Page 2 WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Alliant Engineering for a preliminary plat for "Elm Creels Highlands East", subject to the following conditions: 1. A preliminary plat is approved for the creation of 77 single-family lots and two outlots for "Elm Creels Highlands East", in accordance with the application received by the city on May 26, 2010 and revised plans received by the city on July 6, 2010 and revised plat and site plan received on July 13, 2010, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the reguiding and rezoning of the site. 3. Approval of the preliminary plat is contingent upon City Council approval of the Elm Creels Highlands Third Addition preliminary plat and PUD amendment, which is needed to provide road access, utilities including gravity sewer, regional ponding and required trails for the subject development. 4. Approval of the preliminary plat is contingent upon City Council approval of the wetland replacement plan. 5. Setbacks for this development shall comply with the RSF-3 zoning standards; no variances are approved or implied. 6. Prior to impacting any wetlands or proceeding with grading, the applicant shall install tree preservation fencing and silt fencing and request inspections. The developer shall work with the city forestry division in the field to verify that the trees slated for preservation are protected throughout the development process. 7. Prior to submittal of the final plat application, the applicant shall submit the required information and revise the plans as indicated below consistent with the city code, zoning ordinance and engineering guidelines as may be applicable: a. Assessments/easements/agreements/permit requirements: 1) Watermain area charges: The current rate is $3,525 per acre. Existing wetlands shall be subtracted from the total acreage. To be determined with final plat submittal. 2) Sanitary sewer area charges: The current rate is $950 per acre. Existing wetlands shall be subtracted from the total acreage. To be determined with final plat submittal. Res. 2010-213 File 2010048 Page 3 3) Revise the drainage and utility easement on Lot 4, Block 1 to keep pond high water level within the easement. 4) The city shall not be responsible for the maintenance of any retaining walls or staircases on Outlot A or Outlot B or in drainage and utility easements. The applicant shall either remove walls and stair cases from the public outlots and easements or submit encroachment agreements. 5) Obtain applicable permits: a. MPCA for sanitary sewer extension b. Minnesota Department of Health for watermain extension and abandonment of existing wells c. Elm Creek Watershed District d. NPDES e. Hennepin County for abandonment of existing septic systems f. City of Plymouth for work in the Schmidt Lake Road right-of-way and building demolitions g. FEMA for updating the flood boundary. 6) The applicant shall provide a disclaimer to be reviewed and approved by city staff, to be provided to all potential buyers regarding the existence of the gun club, its hours of operation, and that repetitive, loud noise is produced during those hours. 7) Due to the location of house pads in relation to the wetlands and wetland buffer for Lot 45, Block 2, and Lot 53, Block 2, there is a small amount of useable rear yard area. The purchase agreements for these lots, as well as any marketing materials for this development, shall clearly disclose that these lots have wetland and wetland buffer areas, and are subject to wetland buffer setback requirements. Submit the disclosure to the city for review and approval. 8) Submit an application to vacate all existing easements on the property. 9) Provide trail easements for all trails outside of Outlot A and Outlot B. 10) Submit the conservation easement in recordable form. b. Grading, water resources plan, and erosion control plan requirements: 1) The lowest floor elevation must be a minimum of two feet above adjacent water bodies. In addition, there must be a minimum of 18 inches of freeboard between the lowest building opening where storm water may enter (doors or window) and the designated emergency overflow. 2) Erosion control measures and details must be shown on plan, including silt fence, rock constriction entrance, inlet protection, and erosion control blanket on 3:1 slopes and greater. 3) Drainage swales must have minimum grades of 1.75 percent. 4) Maintenance access shall be provided for ponds and all off-road sanitary sewer and storm sewer manholes. 5) Call out house types and low floor elevations on the grading plan. Res. 2010-213 File 2010048 Page 4 6) A storm water pollution prevention plan (SWPPP) must be prepared for the development. The SWPPP needs to identify responsible parties and include contact information. 7) All retaining walls that cross proposed property lines or support roadway improvements shall be constricted with mass grading operations. 8) Confirm the emergency overflow for the existing wetland located in the southeast corner of the plat. c. Street and utility plans requirements: 1) Include storm sewer profiles, schedules and details. 2) Modify utility note five to reference "Standard Detail Specifications" instead of "Engineering Guidelines". 3) Show sanitary sewer and water service locations. 4) A temporary cul-de-sac may be needed on the west end of 50th Avenue depending on the timing of Elm Creek Highlands third Addition. 5) Maintain a minimum of two feet of freeboard between the high water level of the pond south of 50th Avenue and low point in 50th Avenue. The structural street section of 50th Avenue must also be kept above the high water level of the pond. 6) Call out normal water level and high water level of the wetland west of the plat. 7) Add a catch basin across the street from catch basin 103. 8) Re -assess the driveway alignments for Lots 22 through 25, Block 2. 9) Verify that the trail south of 50th Avenue and west of the pond is above the high water level of pond. 10) The sanitary sewer pipe extending to Schmidt Lake Road crosses under an existing storm sewer pipe. Support storm sewer pipe in place and insulate over the sanitary pipe. 11) Re-evaluate street grades in the vicinity of catch basin 307. d. Water resource plan requirements: 1) Indicate concrete trick washout areas. 2) Drainage calculations for the shared pond with Elm Creek Highlands Third Addition shall demonstrate compliance with requirements for TSS, phosphorus, volume, and rate control for all areas draining to the pond. e.Provide a description of the fence type that would be used above the retaining walls exceeding four feet in height. f. Identify all trails with 8 -foot bituminous surface. g. Identify a trail from 51" Avenue to Jewel Circle rather than a sidewalk. h. Identify a trail on Schmidt Lake Road including curb cuts at intersections and/or road crossings. i. Provide grades for proposed trails and curve radius information for the proposed trail switchbacks to ensure safe and accessible trails. j. Identify the trail centered between the two smaller wetlands. The trail is currently at the edge of one of the smaller wetlands. k. Identify a boardwalk for the section of trail on the north end of the property (in Outlot A) that crosses a wetland or revise the trail location out of the wetland. 1. Revise the site plan to add the area of conservation easement to the density table. Res. 2010-213 File 2010048 Page 5 m. Revise the tree preservation plan and submit a reforestation plan in compliance with section 530 of the city code. Specifically, identify reforestation on the site for the removals over 50 percent, according to the reforestation requirements of section 530.07 of the city code. 8. All sidewalks along local streets and all trails and sidewalks shall be constricted at the same time as the streets and utilities. 9. Should the final plat of this subdivision precede the final plat of the property to the west, separate drainage and utility easement documents will be required to be recorded with the plat and financial guarantees will be required for constriction of the pond. 10. Standard Conditions: a. No building permits shall be issued until the final plat, the HOA documents, all easements, and agreements are filed and recorded with Hennepin County and proof of recording is submitted to the city. b. Any signage shall comply with the city's signage regulations. c. Building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. d. Compliance with the city's tree preservation regulations. Should field adjustments to the tree preservation fencing result in additional impact, the impact shall require review as outlined in Section 530.19 of the city code. e. Removal of all hazardous trees from the property at the owner's expense. £ This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the city to extend the expiration date for up to one additional year, as regulated under Section 510 of city code.
