RESOLUTION No. 2010-211
A RESOLUTION APPROVING A COMPREHENSIVE PLAN AMENDMENT FOR ESTATE
DEVELOPMENT CORPORATION FOR "ELM CREEK HIGHLANDS EAST" FOR PROPERTY
LOCATED NORTH OF SCHMIDT LAKE ROAD AND JEWEL LANE (2010044)
WHEREAS, Estate Development Corporation has requested an adjustment of land use
guiding of LA -2 (Living Area 2) and P -I (Public/Semi-Public/Institutional) for the 31.1 -acre
"Elm Creels Highlands East" plat located north of Schmidt Lake Road and Jewel Lane; and
WHEREAS, the reguiding would accommodate the dedication of the proposed P -I area
(including Outlot A and Outlot B, consisting of 6.92 acres) to the public for the Northwest
Greenway corridor, leaving the remaining 24.2 acres of the property guided LA -2; and
WHEREAS, the properties affected by the amendment are presently legally described as
follows:

WHEREAS, the Planning Commission has reviewed said request at a duly called Public
Hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF
THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the
request by Estate Development Corporation for an adjustment of the boundaries between the
areas guided LA -2 and P -I for the subject property, in accordance with the proposed "Elm
Creek Highlands East' application received by the city on May 26, 2010 and revised plans
received by the city on July 6, 2010 and revised plat and site plan received on July 13, 2010,
and based on the following findings:
1. The guiding adjustment is supported by current conditions.
2. The guiding adjustment would not adversely affect land supply or demand.
3. The guiding adjustment has merit beyond the interests of the applicant.
4. The guiding adjustment would not result in negative effects on other comprehensive plan
elements.
5. The guiding adjustment would not result in negative fiscal impacts to the city.
FURTHER, approval of the comprehensive plan amendments is contingent upon, and
subject to, the required review and response by the Metropolitan Council.
