HomeMy WebLinkAboutCity Council Resolution 2010-200CITY OF PLYMOUTH RESOLUTION NO. 2010-200 A RESOLUTION APPROVING A PRELIMINARY PLAT FOR PULTE HOMES OF MINNESOTA FOR "THE WILLOWS" FOR PROPERTY LOCATED AT THE SOUTHWEST CORNER OF JUNEAU LANE AND COUNTY ROAD 47 (2010041 WHEREAS, Pulte Homes of Minnesota has requested approval of a preliminary plat for roughly 28 acres of land presently legally described as follows: The North 295.95 feet of the West 716 feet of the South 626.40 feet of the West '/z of the Northeast '/4 of Section 4, Township 118, North Range 22, West of the 5th Principal Meridian, Hennepin County, Minnesota. Also that part of the North 330.45 feet of the South 660.90 feet of the West '/z of the Northeast '/4 lying East of the West 716.0 feet thereof, in Section 4, Township 118, Range 22. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Pulte Home of Minnesota for a preliminary plat for The Willows, subject to the following conditions: A preliminary plat is approved for the creation of 46 single-family lots and four outlots for The Willows, in accordance with the plat and plans received by the city on May 3 and June 1, 2010, except as may be amended by this resolution. 2. Approval of the preliminary plat is contingent upon City Council approval of the rezoning of the site. Setbacks for this development shall comply with the RSF-3 zoning standards; no variances are approved or implied. Res. 2010-200 File 2010041 Page 3 4. Prior to impacting any wetlands or proceeding with grading, the applicant shall install tree preservation fencing and silt fencing and request inspections. 5. Prior to recording the final plat, the applicant shall pay park dedication in lieu of land dedication, in accordance with the dedication ordinance in effect at the time the final plat is approved. 6. Prior to recording the final plat, the applicant shall remove all strictures except the home and any outbuildings proposed to be entirely on Lot 2, Block 3. 7. With the final plat application or prior to recording the final plat as may be applicable, the applicant shall submit the required information and revise the plans as indicated below consistent with the city code, zoning ordinance and engineering guidelines as may be applicable: a. Assessments/easements/agreements/permit requirements: 1) Pay the sanitary sewer and watermain assessments as required by city code at the time the plat is approved. 2) Submit the deeds for Outlots A and D. 3) Indicate standard drainage and utility easements: 1) six feet from side and rear property lines and 2) ten feet from public rights-of-way. 4) Submit a trail easement over a trail segment connecting 59th Avenue and the Northwest Greenway trail corridor between lots 7 and 8, Block 3. Revise the plans as necessary to indicate the trail segment in this location. 5) Dedicate Juneau Lane right-of-way south of 59th Avenue with 33 feet of right-of- way from the existing centerline. Verify that the easement is measured from the centerline rather than the property line as shown. 6) Indicate County Road 47 right-of-way as required by Hennepin County. Alter the plans to document the existing legal descriptions. 7) Indicate a 20 -foot drainage and utility easement centered on all public utilities outside the public right-of-way. 8) Submit an unobstructed access easement as a separate document for maintenance of the pond and the sanitary sewer manholes outside rights of way. The accesses must be 15 feet wide and have a slope of less than ten percent with a 12 -foot wide driving surface capable of supporting maintenance equipment. 9) Indicate drainage and utility easements over all ponds and wetlands to the 100 -year high water elevation and over the rain garden. I O) Execute an encroachment agreement to allow plantings, to be maintained by the Homeowner's Association, in the right-of-way along County Road 47 and 60th Avenue. 11) Execute an encroachment agreement for retaining walls that cross into drainage and utility easements on Lots 10, 12, 14-19, Block 2 and Lots 1, 2, 4-7, 11-16, Block 3. The applicant shall minimize the walls in the drainage and utility easements to the extent possible. 12) Execute a maintenance agreement for the rain garden. Res. 2010-200 File 2010041 Page 4 13) Submit disclosure documents notifying potential buyers about the city's intent to close Juneau Lane when Cheshire Parkway is extended to County Road 47. 14) Submit HOA documents and include responsibility for maintaining all retaining walls that cross property lines, the landscaping along County Road 47, sidewalks, wetland buffers and wetland buffer monuments. 15) Vacate the 43 -foot wide drainage and utility easement shown on the existing topography sheet prior to recording the final plat. 16) Vacate the 27 -foot wide street and utility easement on property 04-118-22-13-0010. 17) Permits as follows: MPCA (sanitary sewer extension); Department of Health (water main extension and well abandonment); Elm Creek Watershed District; NPDES; Hennepin County (abandonment of onsite sewage systems, directional boring of watermain and street connection to County Road 47); and City of Plymouth for building removal and work in Juneau Lane right-of-way. 18) Revise the preliminary plat to correct the lot arrangement behind Lot 2, Block 3 so that the areas above and below the walls are maintainable by the adjacent property owners. b. Revise the grading, water resources plan, and erosion control plan to: 1) Include the wetland buffers and buffer monuments. Revise the monuments on Lot 12, Block 3 and Lots 1 and 2, Block 1. 2) Identify the 100 -year flood elevation of existing wetlands. Consider applying for a LOMR or LOMA to alter the floodmap for this area. 3) Show location of concrete trick washout station on grading and drainage plan and include a detail. 4) Show a trail from County Road 47 to the Northwest Greenway trail corridor and a sidewalk from the trail to Lot 18, Block 3 along the south and west side of Niagara Lane. Revise other plan sheets to be consistent with this trail location. 5) Demonstrate that site grading matches the existing ditch profile along County Road 47. 6) Remove existing driveways and culverts along County Road 47. 7) The controlling elevation for the emergency overflow (EOF) on the east end of the plat appears to be the street elevation at the intersection of 59th Avenue and Kingsview Lane. Verify the EOF and adjust the low floor elevations in Block 1 accordingly. 8) Add a stormwater protection plan (SWPP) along with responsible parties and contact information. 9) Submit drainage calculations that demonstrate compliance with requirements for total suspended solids and phosphorus for all areas draining to the pond. c. Submit a street light and signage plan. d. Revise the street and utility plans as follows: 1) Add and relocate hydrants to approved locations. 2) Submit fire flow calculations for the entire development and the first phase of the development flowing the two highest elevation remote hydrants simultaneously. Each hydrant must flow 1500 gallons per minute at 20 psi residual pressure. Res. 2010-200 File 2010041 Page 5 3) Add an additional watermain connection in County Road 47 to provide adequate flow and pressure or provide a ten -inch watermain in Niagara Lane to the intersection with 60th and 59th Avenues and an eight -inch internally looped watermain as an alternative to the second connection. 4) Revise the plans to keep the storm sewer between curbs. 5) Extend a watermain stub to the east side of Juneau Lane at 59th Avenue. 6) Add sanitary sewer manholes and watermain bends to keep sewer and water mains between curbs. 7) Minimize watermain crossings of sanitary sewer to the extent possible. 8) Add/revise the following utility notes: 1) note 5 -sheet 8, add Plymouth engineering standard detail specifications; 2) note 13 -sheet 9, change to read "Contractor shall install megalugs per city standards"; and 3) clarify note 4 on sheet 8. 9) All streets need to be a minimum 28 feet wide. 10) Adjust existing sanitary sewer manhole elevations to match the new street grade. 11) Correct Kingsview Lane spelling on all plan sheets. 12) Use of the existing culvert at manhole 103 will not be permitted, unless the pipe and flared end section is reinforced concrete pipe. 13) Verify whether a culvert is needed under Niagara Lane. 14) Extend the median island through the fiill curve on Niagara Lane. 15) Signing and striping shall be modified to convert the existing eastbound bypass lane on County Road 47 to a right turn lane at Niagara Lane. 16) Provide the fiirther documentation requested by Hennepin County demonstrating that concerns regarding traffic separation, headlight screening, trail accommodations, space for utilities and snow storage, storm drainage, etc. in the area between County Road 47 and 60th Avenue have been addressed. e.Revise the tree preservation/inventory/landscaping plan as follows: 1) Remove the exempt categories on the inventory for the County Road 47 alignment and sanitary sewer extension. Remove the exempt trees from the total significant tree inches and recalculate the required number of removed trees. 2) Substitute other conifers for Black Hills spruce to reduce the dominance on this specie. 3) Relocate proposed trees outside wetland buffers and show the wetland buffers for both this development and the adjacent Taryn Hills development on the plans. 4) Add the trees for widening the 24 -foot street segment to 28 feet to the disturbed category and amend the calculations as necessary. 8. The sidewalks along all local streets, the optional loop of the Northwest Greenway, and the trail connection between Lots 7 and 8 shall be installed at the same time as the streets and utilities. 9. The home at 5835 Juneau Lane must be connected to city sewer and water with this development. Res. 2010-200 File 2010041 Page 6 10. All lowest floor elevations shall be a minimum of two feet higher than the calculated 100 - year high water elevation of adjacent ponds or wetlands. Additionally, the lowest building opening where storm water may enter (door or window) shall be a minimum of 18 inches higher than the overland overflow. 11. Standard Conditions: a. No building permits shall be issued until the final plat, the HOA documents, all easements, and agreements are filed and recorded with Hennepin County and proof of recording is submitted to the city. b. Any signage shall comply with the city's signage regulations. c. Building permits are required for retaining walls 48 inches in height or higher. Additionally, a fence shall be installed at the top of retaining walls that exceed four feet in height. d. Compliance with the city's tree preservation regulations. Should field adjustments to the tree preservation fencing result in additional impact, the impact shall require review as outlined in Section 530.19 of city code. e. Removal of all hazardous trees from the property at the owner's expense. f. This approval shall expire one year after the date of approval, unless the property owner or applicant has substantially started constriction of the project, or unless the landowner or applicant has received prior approval from the City to extend the expiration date for up to one additional year, as regulated under Section 510 of City Code.
