HomeMy WebLinkAboutCity Council Resolution 2010-197CITY OF PLYMOUTH RESOLUTION No. 2010-197 A RESOLUTION AUTHORIZING THE VACATION FOR ALL OF PLATTED LAKEVIEW DRIVE NOW KNOWN AS 9T" AVENUE WITHIN PARKDALE ADDITION WHEREAS, a public hearing with respect to said vacation was scheduled for July 27, 2010 in accordance with Minnesota Statutes 412.851 and the City Charter Section 12.06; and WHEREAS, a notice of publication of said hearing was published and posted two weeks prior to the meeting of July 27, 2010; and WHEREAS, all property owners adjacent to the proposed vacation were duly notified by mail; and WHEREAS, the City Council did hold a public hearing on July 27, 2010 to inform any and all interested parties relevant to the vacation of that portion of platted Lakeview Drive now known as 91h Avenue within Parkdale Addition; and WHEREAS, Xcel Energy requests access for utility maintenance purposes over the westerly 10 feet of vacated 9th Avenue; and WHEREAS, the City will retain drainage and utility access and maintenance rights over all of vacated 9th Avenue; and WHEREAS, it was determined by the City Council that 9th Avenue is not needed for public purposes. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA: That the following platted right-of-way within Parkdale Addition be vacated: All of platted Lakeview Drive now known as 9th Avenue with Parkdale, lying west of the westerly right-of-way extended of Parkdale Drive now known as Kingsview Lane. FURTHER, that said vacation shall not affect the authority of any person, corporation, or municipality owning or controlling the electric or telephone poles and lines, gas lines, sanitary and storm sewer lines, water pipes, mains, hydrants, and natural drainage areas thereon or there under, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, remove, or otherwise attend thereof.
