RESOLUTION No. 2010-192
A RESOLUTION APPROVING A CONDITIONAL USE PERMIT TO ALLOW AN INDOOR COMMERCIAL
RECREATIONAL USE FOR SKY ZONE FOR PROPERTY LOCATED AT 13310 INDUSTRIAL PARK
BOULEVARD (2010045)
WHEREAS, Sky Zone has requested approval of a conditional use permit for the site
legally described as follows:
Parcel 1:
That part of Lots 1, 2, 3 and 4, Block 1, Minneapolis Industrial Park and that part of the
Northeast '/4 of Section 27, Township 118 North, Range 22 West of the 5th Principal
meridian, Hennepin County Minnesota, described as follows:
Commencing at the Southwest corner of Lot 1, Block 3, Minneapolis Industrial Park;
thence Northwesterly along the Southwesterly line of said Lot 1 a distance of 318.17 feet;
thence on a tangential curve to the left with a radius of 640.97 feet and a central angle of
62 degrees 36 minutes 25 seconds to a point 20 feet North of the North line of Lot 2,
Block 3, Minneapolis Industrial Park; thence Westerly parallel with the North line of said
Lot 2 a distance of 144.42 feet; thence on a tangential curve to the right with a radius of
408.88 feet and a central angle of 86 degrees 40 minutes; thence Northerly in a straight
line tangent to the last described curve a distance of 480.94 feet; thence Northerly along a
tangential curve to the right, having a radius of 399.26 feet to an intersection with the
South line of said Block 1, said point of intersection being the actual point of beginning
of the tract of land to be described; said actual point of beginning, distant 39.43 feet West
of the Southeast corner of Lot 4 in said Block 1; thence continuing Northeasterly along
last described curve to an intersection with a line parallel with and 425 feet Northerly,
measured along the Westerly line of Lot 1 in said Block 1, from the South line of said
Block 1; thence Easterly to a point on the Easterly line of Lot 2 in said Block 1, distant
413 feet Northerly, measured along said Easterly line, from the Southeast corner of last
said Lot 2; thence Northerly along said Easterly line 12 feet to aforesaid parallel line;
thence North 88 degrees 43 minutes 40 seconds East along said parallel line 13.41 feet;
thence North 1 degree 15 minutes 20 seconds West, 123.78 feet; thence Westerly and
Southwesterly 812.58 feet along a curved line concave to the Southeast having a radius of
399.26 feet, to a point bearing North 4 degrees 36 minutes 20 seconds West, 151.75 feet
from the actual point of beginning; thence South 4 degrees 36 minutes 20 seconds East
151.75 feet to the actual point of beginning.

Together with two (2) easements for roadway purposes measuring twenty-four (24) feet
in width over and across the property situated in the County of Hennepin, State of
Minnesota, and legally described as follows, to -wit:
That part of Lots 3 and 4, Block 1, Minneapolis Industrial Park and that part of the
Northeast '/4 of Section 27, Township 118, Range 22, described as follows:
Commencing at the Southeast corner of Lot 2, Block 1, Minneapolis Industrial Park;
thence Northwesterly along the Easterly line of Lot 2 a distance of 352.33 feet; thence
North 1 degree 16 minutes 20 seconds West along a line parallel with the West line of
said Block 1, a distance of 195.20 feet to the actual point of beginning of the tract of land
to be described; thence Westerly and Southwesterly 812.58 feet along a curved line
concave to the Southeast having a radius of 399.26 feet to a point bearing North 4
degrees 36 minutes 20 seconds West, 151.75 feet from a point in the South line of Lot 4,
Block 1, distant 39.43 feet West of the Southeast corner of said lot 4; thence North 4
degrees 36 minutes 20 seconds West, 127.94 feet; thence Northerly and Northeasterly
714.89 feet along a curve concave to the Southeast having a radius of 419.26 feet to a
point bearing North 1 degree 16 minutes 20 seconds West from the actual point of
beginning; thence South 1 degree 16 minutes 20 seconds East, 21.68 feet to the actual
point of beginning, according to the plat thereof on file and of record in the office of the
Registrar of Deeds in and for Hennepin County, Minnesota, and according to the United
States Government Survey thereof, and situated in Hennepin County, Minnesota, as said
easement is set out in Document No. 4248104.
Parcel 2:
That part of Lot 3 and 4, Block 1, Minneapolis Industrial Park and that part of the
Northeast '/4 of Section 27, Township 118, Range 22, Hennepin County, Minnesota,
described as follows:
Commencing at the Southeast corner of lot 2 in said block 1; thence Northerly along the
Easterly line of said Lot 2 a distance of 425 feet; thence North 88 degrees 43 minutes 40
seconds East along a line parallel with the South line of said Block 1 a distance of 13.41
feet; thence North 1 degree 16 minutes 20 seconds West 145.46 feet to the actual point of
beginning of the tract of land to be described; thence Westerly and Southwesterly 714.69
feet along a curve concave to the Southeast having a radius of 419.26 feet to a point
bearing North 4 degrees 36 minutes 20 seconds West, 279.69 feet from a point in the
South line of said Lot 4, distant 39.43 feet West of the Southeast corner of said Lot 4;
thence North 4 degrees 36 minutes 20 seconds West, 20.52 feet; thence Northeasterly
182.13 feet along a tangential curve to the right having a radius of 399.26 feet; thence
North 21 degrees 31 minutes 50 seconds East 215.74 feet; thence Northeasterly 24.83
feet along a tangential curve to the left having a radius of 419.26 feet; thence North 88
degrees 43 minutes 40 seconds East along a line parallel with the South line of said Block
1, a distance of 441.91 feet to an intersection with a line bearing North 1 degree 16

minutes 20 seconds East 136.54 feet to the actual point of beginning.
Parcel 3:
That part of Lot 1, Block 1, Minneapolis Industrial Park, Hennepin County, Minnesota,
described as follows:
Beginning at a point in the Westerly line of said Lot 1, distant 425 feet Northerly
(measured along said Westerly line) from the Southwest corner thereof, thence North 88
degrees 43 minutes 40 seconds East along a line parallel with the South line of said Lot 1,
a distance of 13.41 feet; thence South 1 degree 16 minutes 20 seconds East, a distance of
71.42 feet to an intersection with the Westerly line of said Lot 1; thence North 11
degrees 54 minutes 12 seconds West along said Westerly line a distance of 72.67 feet to
the point of beginning.
Parcel 4:
That part of Lots 2, 3 and 4, Block 1, Minneapolis Industrial Park, Hennepin County,
Minnesota, lying Easterly and Southerly of the following described line: Beginning at
the Southwest corner of Lot 1, Block 3, Minneapolis Industrial Park, thence
Northwesterly along the Southwesterly line of said Lot 1, a distance of 318.17 feet;
thence on a tangential curve to the left with a radius of 640.97 feet and a central angle of
62 degrees 36 minutes 25 seconds to a point distant 20 feet North of the North line of Lot
2, Block 3, Minneapolis Industrial Park; thence Westerly parallel with the North line of
said Lot 2, a distance of 144.42 feet thence a distance of 618.48 feet on a tangential curve
to the right with a radius of 408.88 feet and a central angle of 86 degrees 40 minutes;
thence Northerly in a straight line tangent to the last described curve a distance of 480.94
feet; thence along a tangential curve to the right with a radius of 399.26 feet and a central
angle of 93 degrees 20 minutes to an intersection of a line parallel with and distant 425
feet Northerly, measured along the Westerly line of Lot 1, in said Block 1, from the
South line of said Block 1; thence Easterly to a point on the Easterly line of said Lot 2,
distant 413 feet Northerly measured along said Easterly line from the Southeast corner of
said Lot 2, and there terminating.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by Sky Zone for a conditional use permit to allow an indoor recreation use in
the existing industrial building located at 13310 Industrial Park Boulevard, subject to the
following conditions:

1. A conditional use permit is approved to allow a 22,128 -square foot indoor recreational
facility that offers trampoline playing courts, in accordance with the application and plans
received by the city on May 20, 2010, except as may be amended by this resolution.
2. The conditional use permit is approved with the finding that all applicable conditional use
permit standards are met.
3. Prior to construction of tenant improvements in the building, the applicant must obtain
separate approval of a building permit.
4. If the city documents a parking problem that cannot be resolved, the city may revolve the
conditional use permit.
5. Standard Conditions:
a. Any signage shall comply with the city's sign regulations.
b. All waste and waste containers shall be stored within approved designated areas.
c. All parking shall be off-street in designated areas which comply with the zoning
ordinance.
d. Subsequent phases or expansions are subject to required reviews and approvals per
ordinance provisions.
e. This approval shall expire one year after the date of approval, unless the property owner
or applicant has started the project, or unless the landowner or applicant has received
prior approval from the city to extend the expiration date for up to one additional year, as
regulated under Section 21015.07 of the zoning ordinance.
