HomeMy WebLinkAboutCity Council Resolution 2010-186CITY OF PLYMOUTH RESOLUTION No. 2010-186 A RESOLUTION APPROVING AN INTERIM USE PERMIT FOR HAMPTON HILLS INVESTMENTS, LLC, FOR PROPERTY LOCATED AT 5733, 5741, AND 5743 JUNEAU LANE NORTH (2010043) WHEREAS, Hampton Hills Investments, LLC has requested approval of an interim use permit to allow grading/excavation operations related to installation of a trunk sanitary sewer line for property legally described as follows: The Northeast Quarter of the Northeast Quarter of the Southwest Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota, except the east five acres thereof. M The Southeast Quarter of the Northeast Quarter of the Southwest Quarter of Section 4, Township 118, Range 22, Hennepin County, Minnesota. WHEREAS, the Planning Commission has reviewed said request at a duly called public hearing and recommends approval. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Hampton Hills Investments, LLC for an interim use permit for grading/excavation operations at 5733, 5741, and 5743 Juneau Lane North, subject to the following conditions: 1. This interim use permit is approved to allow grading/excavation of roughly 7,000 cubic yards of soil, in accordance with the plans received by the city on June 1, 2010, except as may be amended by this resolution. 2. Prior to issuance of the required grading permit, silt fencing shall be installed as required to protect water quality. 3. The banks of the excavation shall be sloped and properly guarded so as not to create a danger from caving or sliding banks. The grading/excavation shall be maintained within the area indicated on the grading permit, and top soil shall be retained for use in the restoration of the site. Fencing shall be provided if the excavation is not backfilled within six months. Res. 2010-186 (File 2010043) Page 2 4. Compliance with section 2025 (noise) of the city code. The hours for grading/excavation operations shall be limited to between 7:00 AM and 7:00 PM Mondays through Fridays, and between 8:00 AM and 6:00 PM on Saturdays. 5. The applicant shall complete all site restoration, including seeding to establish a vegetative ground cover, within six months from the date of approval of the interim use permit by the City Council. 6. The permit is subject to all applicable codes, regulations and ordinances, and violation thereof shall be grounds for revocation. ADOPTED by the City Council on July 13, 2010.
