RESOLUTION No. 2010-185
A RESOLUTION APPROVING A PRELIMINARY PLAT, FINAL PLAT, AND DEVELOPMENT
CONTRACT FOR HAMPTON HILLS INVESTMENTS, LLC FOR "HAMPTON HILLS—PHASE I"
FOR PROPERTY LOCATED EAST OF 5550 VICKSBURG LANE (2010043)
WHEREAS, Hampton Hills Investments, LLC has requested approval of a preliminary
plat and final plat for the 40 -acre site presently legally described as follows:
The Southeast Quarter of the Southwest Quarter of Section 4, Township
118, Range 22, Hennepin County, Minnesota.
WHEREAS, the Planning Commission has reviewed said request at a duly called public
hearing and recommends approval; and
WHEREAS, city staff has prepared a development contract covering the improvements
related to said plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE MAYOR AND CITY
COUNCIL OF THE CITY OF PLYMOUTH, MINNESOTA, that it should and hereby does
approve the request by Hampton Hills Investments, LLC for a preliminary plat and final plat for
Hampton Hills—Phase I; and
FURTHER, that the development contract for said plat be approved, and that upon prior
execution of the development contract by the developer, the Mayor and City Manager be
authorized to execute the development contract on behalf of the city; and
FURTHER, that the following conditions be met prior to recording of, and related to said
plat:
1. A preliminary plat and final plat is approved to allow a 14 -lot single-family subdivision, in
accordance with the plat and plans received by the city on June 1, 2010, except as may be
amended by this resolution.
2. Approval of the plat is contingent upon City Council approval of the rezoning of the site to
RSF-2.
3. Approval of the plat is contingent upon City Council approval of the Taylor Creels
subdivision (File No. 2010035).
4. Prior to issuance of a grading permit or any grading activities, the applicant shall install
and request inspection of tree preservation fencing and silt fencing.

5. Prior to recording the final plat, the applicant shall pay the park dedication fee in lieu of
land dedication for 14 new residential units, in accordance with the dedication ordinance in
effect at the time the final plat is recorded.
6. Prior to recording the final plat, the applicant shall fulfill the requirements, submit the
required information, and revise the plans as indicated below, consistent with the applicable
city code, zoning ordinance, and engineering guidelines:
a. Assessment/easement/agreement/permit requirements:
(1) Payment of watermain area charges, per the rates as identified in the development
contract (2010 rates amount to $34,023.30).
(2) Payment of sanitary sewer area charges, per the rates as identified in the
development contract (20 10 rates amount to $9,169.40).
(3) Easements are required for utilities and the temporary cul-de-sac proposed beyond
the north boundary of the plat.
(4) Easements are required for utilities (within stub street alignments) that lie beyond
the 55th Avenue right-of-way.
(5) Easements on the two properties to the north (PINS O4-118-22-31-0007 and 04-
118-22-31-0008) must align with the proposed trunk sanitary sewer location.
(6) Provide an access easement to the public right-of-way for Lot 1, Block 2.
(7) Confirm Hennepin County setback requirements are met for the existing septic
system and drainfield on Lot 1, Block 2.
(8) Confirm Minnesota Department of Health setback requirements are met for the
existing well on Lot 1, Block 2.
(9) Specify whether individual home owners or a homeowner's association, as
reviewed and approved by the city, will maintain the sidewalks within the
development.
(10) Sanitary sewer must be extended to the west boundary of the plat to tie into 55th
Avenue within the proposed Taylor Creek subdivision. Sanitary sewer must also
be extended, or an easement and agreement shall be provided for extension of
sanitary sewer, to the west boundary of the plat to tie into 53rd Avenue within the
proposed Taylor Creek subdivision.
(11) Prior to any grading, installation of utilities or constriction, the applicant shall
obtain the necessary, applicable permits and approvals as follows: DNR, MPCA,
Minnesota Department of Health, Shingle Creek Watershed Management
Commission, and NPDES.
b. Grading and erosion control plans:
(1) Identify the lowest floor elevation at a minimum of two feet above the adjacent
water bodies. In addition, there must be a minimum of 18 inches of freeboard

between the lowest building opening where storm water may enter (doors or
windows) and the designated emergency overland overflow.
(2) Show normal and high water level elevations for wetlands 3 and 8 on all plan
sheets.
(3) Provide a silt curtain or sediment mat at the downstream end of the culvert to be
placed in Bass Creek.
(4) Extend the access road from the Taryn Hills development to sewer manhole 1.
(5) Restore wetlands 9 and 10 after completion of trunk sanitary sewer constriction.
c. Street and utility plans:
(1) The comprehensive plan indicates a 12 -inch watermain in 55t1' Avenue. The city
will not be responsible for the cost of oversizing the water main from 12 inches to
16 inches.
(2) Street curves on 55th Avenue must meet 30 MPH design speed.
(3) Access to city water is required.
(4) Provide pipe velocity data in Bass Creek for culvert sizing under 55t1' Avenue.
Depending on velocities, additional riprap may be required.
(5) Relocate the temporary cul-de-sac on the north end of 55th Avenue to minimize
wetland impacts.
(6) Show pedestrian ramps at all locations where sidewalks intersect with curbs.
(7) The sanitary sewer line for Lot 7, Block 2 must be parallel with the water service.
(8) Square up street constriction on 55th Avenue with the Taylor Creek plat.
(9) Install insulation beneath the sanitary sewer crossing of the 36 -inch storm culvert
at Bass Creek.
(10) Relocate the 16 -inch watermain so it is not under concrete curbing.
(11) Eliminate trash guards on the 36 -inch culvert crossing of 55t1' Avenue.
(12) Confirm the service area for sanitary sewer stubs at manholes 3, 7, and 9.
(13) Show a 36 -inch culvert crossing in storm sewer profile A.
(14) Confirm the amount of energy dissipation needed for the outlet end of storm
sewer profile I.
(15) Use PVC for sanitary sewer from manhole 7 to manhole 8.
(16) Install a 36 -inch culvert for Bass Creek under 55th Avenue with trunk sanitary
sewer constriction.
(17) Show existing well and septic system locations for Lot 1, Block 2.
(18) Sanitary sewer and water service must be shown to Lot 1, Block 2 in the next
platting phase for the Hampton Hills development.

d. Water resource plan:
(1) Indicate concrete trick washout areas.
(2) Approval of the final plat is contingent upon City Council approval of the
wetland replacement plan.
(3) Submit drainage calculations for the shared pond with the Taylor Creek
development that demonstrate compliance with requirements for total
suspended solids, phosphorus, volume, and rate control for all areas
draining to the pond.
7. The individual home owners or a homeowner's association shall be responsible for
maintenance and repair of buffers, buffer monuments, plantings in the right-of-way, and
sidewalks.
8. The sidewalks along all streets shall be installed at the same time the streets are installed.
9. Compliance with the city's tree preservation regulations. Tree preservation shall be
recalculated based on the entire site upon submission of the preliminary plat application for
the remainder of the land controlled by Tradition Development/Plymouth Development
Corporation/Hampton Hills Investments, LLC. In the meantime, the applicant shall provide
a financial surety for the required reforestation calculated for the Phase I plat.
10. Standard Conditions:
a. No building permits shall be issued until the final plat, any HOA documents, and all
easements and agreements are filed and recorded with Hennepin County and proof of
recording is submitted to the city.
b. Development standards and setbacks shall comply with the RSF-2 zoning standards. No
variances are granted or implied.
c. Any signage shall comply with the city's signage regulations.
d. Street names shall comply with the city's street naming system.
e. Building permits are required for retaining walls 48 inches in height or higher.
Additionally, a fence shall be installed at the top of retaining walls that exceed four feet
in height.
f. Removal of all hazardous trees from the property at the owner's expense.
g. This approval shall expire two years after the date of approval, unless the property owner
or applicant has substantially started constriction of the project, or unless the landowner
or applicant has received prior approval from the city to extend the expiration date, as
regulated under section 512 of City Code.
