RESOLUTION 2010-181
APPROVING A SITE PLAN, CONDITIONAL USE PERMITS, AND VARIANCE FOR
QUEST DEVELOPMENT, INC. FOR 51 APARTMENT-SYLE UNITS IN TWO
STRUCTURES ON PROPERTY LOCATED AT 9805 HIGHWAY 55 (2005042)
WHEREAS, Quest Development, Inc. has requested a one-year extension of the final approval of
a site plan, conditional use permits, and variance to allow the constriction of 51 apartment -style
units in two building on the 4.34 -acre site located at 9805 Highway 55, presently legally
described as follows:
Lots I and 2, Block 1, Homestead Village Incorporated according to the recorded plat
thereof, Hennepin County, Minnesota.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY
OF PLYMOUTH, MINNESOTA, that it should and hereby does approve the request by Quest
Development, Inc. for a one-year extension of the approval of the site plan, conditional use
permits, and variance to allow constriction of 51 apartment -style units in two building on the
4.34 -acre site located at 9805 Highway 55, subject to the following conditions:
1. Approval of the site plan, conditional use permits and variance is contingent upon City
approval of the comprehensive plan amendment from CO (Commercial Office) to LA -4
(Living Area 4) and rezoning the site from O (Office) to RMF -4 (Multiple Family 4).
2. The site plan is approved in accordance with the plans received by the City on April 15, 2005
and May 20, 2005, except as may be amended by this Resolution.
3. The conditional use permits are approved to allow 1) two principal buildings on the property
and 2) the height of the buildings to be 53 feet where the ordinance allows 45 feet based upon
the findings that the conditional use permit standards have been met.
4. A variance is approved to allow a 10 -foot setback from the north property line where the
ordinance requires 30 feet, based on the findings that the variance standards have been met.
5. All other development standards shall be as required by the RMF -4 zoning district. With the
exception of the above, no variances are granted or implied.
6. Prior to issuance of a building permit, the applicant shall submit the revised plans consistent
with sections 21105.06 (exterior lighting), 21130.03 (required fencing, screening, and
landscaping) and 21115.07 (two family, townhouse, manor home, multiple family uses).
7. Prior to issuance of building permits, the applicant must install the required permanent
wetland buffer monuments pursuant to ordinance requirements.

8. Prior to issuance of building permits, the applicant shall execute a Site Improvement
Performance Agreement (SIPA) and submit the required financial guarantees.
9. Prior to issuance of a building permit, the applicant shall provide the City with copies of the
homeowner's association (HOA) documents for the development. The HOA shall be
responsible for maintenance of the site, including the wetland, wetland buffers, monument
signs, landscaping and similar features within the development.
10. Prior to issuance of a certificate of occupancy, the applicant shall provide the City with proof
that the HOA documents have been recorded against the property.
11. Prior to issuance of a certificate of occupancy, the wetland mitigation for the property shall
be completed.
12. Prior to issuance of a building permit, the applicant shall submit a lighting plan with fixture
details in conformance with the Zoning Ordinance; specifically, the applicant shall revise the
plans to address the installation of side shields to prevent spill light to adjacent residential
and mounting height.
13. Prior to issuance of a building permit, the developer shall obtain the necessary permits and
approvals as follows: MnDOT, MPCA, Minnesota Department of Health, Wetland
Conservation Act, Bassett Creek Water Management Commission, NPDES, and City right-
of-way permit.
14. Prior to issuance of a building permit, the applicant shall revise the plans to show consistency
with the most recent version of the Engineering Guidelines and as follows:
a. Identify the Fire Department connection and lockbox locations on each building in an
approved location.
b. Use C900 PVC watermain and for fire and domestic service.
c. Identify water services on north side of building that are to be removed on page C4-1.
d. Use storm sewer casting R -1642-B on east side of building.
e. Change note number I I on page C4-1 to demonstrate that watermain and service shall be
PVC C900 (DR) 18.
f. Determine if there is a gate valve for the private water line at the south driveway and
show on the plan.
g. Add note on page C4-1 that all utilities are private.
h. Provide wetland mitigation plan consistent with the plan approved June 14, 2004.
i. Use the existing sanitary sewer service to avoid cutting into Nathan Lane.
j. Provide a positive overland overflow from the area along the east side of Building B.
k. Install pedestrian ramps for all locations the trail crosses a driveway.
1. Extend the curb on the north side of the north driveway around the Nathan Lane curve.
m. Add "Begin One Way" and "End One Way" signs on both sides of the fire lane as well as
another "One Way Do Not Enter" on the north side of the fire lane.

n. Add wetland buffer monument locations on the grading plan in compliance with the
Zoning Ordinance.
15. Standard Conditions:
a. Removal of all hazardous trees from the property at the owner's expense.
b. Sod shall be used to restore all disturbed portions of the site outside the wetland buffer.
c. All signage shall require separate permits and shall be in conformance with the Zoning
Ordinance.
d. The fire lane signage shall be added in approved locations.
e. An approved solenoid devise must be connected to each combination building
domestic/fire protection water supply line. The solenoid valve must shut off all site
domestic water on activation of the building fire sprinkler system.
f. Prior to issuance of a building permit, the applicant shall submit fire flow calculations
flowing the remote two highest elevation hydrants simultaneously. The hydrants must be
capable of flowing a minimum of 1500 GPM at 20 PSI.
g. Both buildings shall be completely protected by a City approved, monitored, automatic
fire sprinkler system.
h. An 8 1/2 x I I inch "As Built" Fire Protection Plan shall be submitted prior to the release
or reduction of any site improvement financial guarantees per City Ordinance.
i. Compliance with Policy Resolution 79-80 regarding minimum floor elevations for new
strictures on sites adjacent to, or containing any open storm water drainage facility.
j. This extension shall expire one year after the date of approval, unless the property owner
or applicant has substantially started constriction of the project or unless the landowner
or applicant has received prior approval from the City to extend the expiration date for up
to one additional year, as regulated under Section 21045.09 of the Zoning Ordinance.
