Pursuant to due call and notice thereof, a special meeting of the
Village Council of the Village of Plymouth, Minnesota was held on the
14th day of December, 1971. The following members were present:
{ Hayor Hilde, Councilmen Johnson, Hunt and Spaeth. The following member
fwas absent: Councilman Hintz.
Councilman Spaeth introduced the following Resolution and moved its
adoption:
RESOLUTION NO. 71-458
WHEREAS, Hoffman Brothers, Inc. of Atwater, Minnesota has completed
work on Southeast Water Improvement Project No. 71-0,A, Part A, and
since our contracts do not call for witholding retainage after a project
is completed and it is anticipated there will be settlements and other
corrections required in the spring, and
WHEREAS, the contractor has made every effort to complete the
project this fall approval is requested by the Council to reduce the
retainage fee from $60,343.35 to $10,000.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF PLYMOUTH:
"Approval is hereby granted to reduce the retainage fee from
$60,343.35 to $10,000 for Project No. 71-0,A (Part A), con-
structed by Hoffman Brothers; Inc. of Atwater, Minnesota."
The motion for the adoption of the foregoing Resolution was duly
seconded by Councilman Hutt and upon vote being taken thereon, the
following voted In favor thereof: Mayor Hilda, Councilmen Johnson,
Hunt and Spaeth.
No one voted against or abstained. Whereupon the resolution
was declared duly passed and adopted.

I. the undersigned, being the duly qualified and acting Clerk of
the Village of Plymouth, Minnesota, hereby certify that I have carefully
compared the foregoing extract of the minutes of a special meeting of
the Village Council of said Village held on December 14, 1971, with
the original thereof on file in my office and the same is a full, true
and complete transcript therefrom.
WITNESS, My hand officially as such Clerk and the corporate seal
of the Village this 15th day of December, 1971.
