VILLACE COUNCIL OF
PLYMOUTH, MINNESOTA
Pursuant to due call and notice thereof, a 3&eApW - special meeting of the
Village council of the Village of Plymouth was held on the 9th day of
October , 19 71 , commencing at 10:30 o'clock At'. M. at the Village
Hall, 13800 State Highway 955.
The following members were present:
Mayor Hilda, Councilmen Johnson, Hintz. Spaeth and Hunt.
the following members were absent; None
Councilman Hintz introduced the following resolution and moved its
adoption:

A RESOLUTION CONFIRMING AND ADOPTING
THE ASSESSMENT FOR
36TH AVENUE (ZACHARY TO JONQUIL LANES) STREET & NATER IMPROVEMENT
PROJECT 71-0.8-H
WHEREAS, pursuant to due and proper notice according to law an assessment
hearing wds held on the 7th of October. 1971
relating to special assessmeent$
and,
WHEREAS, all perms present desiring to be heard were heard and their objections,
if any, were noted
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
PLYMOUTH, MINNESOTA, AS FOLLOWS:
"l. The Village Clerk has, with the assistance of the Bonestroo, Rosene & Anderlik
engineers heretofore selected by this council for such purpose, calculated
the proper amounts to be specially assessed for
the 36th Avenue (Zachary to Jonquil Lanes) Water i Street Improvements
against every assessable lot, piece or parcel of land, in accordance
with the provisions of law, and has prepared and filed in his office
tabulated statements in duplicate showing the proper description of
each and every lot, piece or parcel of land to be specially assessed
in the amount calculated against the same,
2. Notice has been duly published as required by law that this council
would meet in regular session at this time and place to pass on the
proposed assessment.
3. The proposed assessment has at all times since its filing been open to
inspection and copying by all persons interested, and an opportunity
has been given to all interested persons to present their objections,
if any, to such proposed assessment, or to' any item thereof, and
no objections have been filed.
4. This Council finds that each of the lots, pieces or parcels of land
enumerated in said proposed assessment was and is specially benefited
by the construction of the 36th Avenue (Zachary to Jonquil Lanes)
Water & Street Improvement
in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land and that said amount is hereby
levied and assessed.
S. Such proposed assessment is affirmed, adopted and confirmed, and the
sums fixed and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed, adopted_.
and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively.
6. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clerk and filed in his office and shall thereupon be
and constitute the special' assessment for the 36th Avenue (Zachary to
Jonquil Lanes) Water and Street Improvements.
7. The amounts assessed against each lot, piece or parcel of land shall
bear interest from the date hereof until the same have been paid at
the rate ofp percent per annum.

S. Such assessments shall be payable in 20 equal annual installments
payable on the lst day of January in each year, beginning in the year
19 72, and continuing until all of said installments shall have been
paid, each installment to be collected with taxes collectable during
said year by the County Auditor. To the first installment shall be
added interest on the entire assessment from the date hereof to
December 31, 19 71 , To each subsequent installmant shall be added
interest for one year on all unpaid installments.
9. The village Clerk tsr hereby directed to make up and file in the office
of the County ?ludizor of Hennepin County a certified statement of the
amount of all of such unpaid assessments and the amount which will be
due thereon on the lst day of January in each year.`
She above motion was seconded by Councilman Johnson and upon vote being
taken thereon, the following voted in favor thereofs
Mayor Hilda, Councilmen Johnson, Hintz, Spaeth and Hort
the following vnted against. None
Whereupon said resolution was declared duly passed and adopted.

I, the undersigned, being the duly qualified Village Clerk
of the Village of Plymouth, Minnesota, hereby certify that I have
carefully compared the attached and foregoing Extract of Minutes of Special
Rraguecs Meeting of the Village Council of the Village of Plymouth held
October 9, 1971 with the original thereof on file in the Village
office and the same is a full, true and complete transcript therefrom
as the same relates toK�i44
the assessment roll adoption for Project #71-0,8-H.
