EXTRACT OF MINUTES OF MEETING OF
VILLAGE COUNCIL OF
PLYMOUTH, MINNESOTA
Pursuant to due call and notice thereof, a raguYar - special meeting of the
Village Council of the Village of Plymouth was held on the 9th day of
October , 19 71 , commencing at 10:30 A.M. o'clock M. at.the Village
Hall, 13800 State Highway #55.
The following members were present: Mayor Hilde, Councilmen Hintz, Runt,
Johnson and Spaeth.

RESOLUTION NO.71-390
A RESOLUTION CCNFIRMING AND ADOPTING
THE ASSESSMENT FOR
SOUTHEAST WATER PROJECT NO. 71-0-A IMPROVEMENT
WHEREAS, pursuant to due and proper notice according to law an assessment
hearing wjts held on the 5th of October, 1971
relating to special assessments
--and,
WHEREAS, all persons present desiring to be heard were heard and their objections,
If any, were noted
NW, THEREFORE, BE IT HERESY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF
PLYMOUTH, MINNESOTA, AS FOLLOWS:
"1. The village Clerk has, with the assistance of the Dotnestroo, Anderlik 6 Rosene
wginears heretofore selected by this council for such purpose, calculated
the proper amounts to be specially assessed for
the Southeast Water Project.
_____against every assessable lot, piece or parcel of land, in accordance
with the provisions of law, and has prepared and filed in his office
tabulated statements in duplicate showing the proper description of
each and every lot, piece or parcel of land to be specially assessed
in the amount calculated against the same,
2. Notice has been duly published as required by law that this council
Mould meet in regular session at this time and place to pass on the
proposed assessment.
3. The proposed assessment has at all times since its filing been open to
inspection and copying by all persons interested, and an opportunity
_ has been given to all interested persons to present their objections,
if any, to such proposed assessment, or to any item thereof, and
8 objections have been filed.
4. This Council finds that each of the lots, pieces or parcels of land
enumerated in said proposed assessment :as and is specially benefited
by the construction of the Southeast Water Project.
in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land and that said amount is hereby
levied and assessed.
S. Such proposed assessment is affirmed, adopted and confirmed, and the
sums fixed and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed, adopted
and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively.
G. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clerk and filed in his office and shall thereupon be
and constitute the special assessment for the Southeast 'dater Project.
7. The amounts assessed against each lot, piece or parcel of land shall
--bear interest from the date hereof until the same have been paid at
Oe rate of g percent per annum.
S. Such assessments shall be payable in 20 equal annual installments
_ �.,petyable on tha_lat.day of January .its each year, beginning in the year
19_x, and continuing until all of said installments shall have been
paid, each installment to be collected with taxes collectable during
{d -year by -the County Auditor. -To the first installment shall be ---- -
added interest on the entire assessment from the date hereof to
December 31, 19 71 , To each subsequent installment shall be added
-----#ntereat -for one year on all unpaid installments.
9. The Village Clerk is hereby directed to make up and file in the office
of the County Auditor of Hennepin County a certified statement of the
amxmt of all of such unpaid assessments and the amount which will be
duo thereon on the lat day of January in each year."

Spaeth, Hintz and Johnson.

I, the undersigned, being the duly qualified Village Clerk
of the Village of Plymouth, Minnesota, hereby certify that I have
carefully compared the attached and foregoing Extract r)f Minutes of Special
YAPSV W Meeting of the Village Council of the Village of Plymouth held
October 9, 1971 with the original thereof on file in the Village
office and the same is a full, true and complete transcript therefrom
as the same relates to authorizing the use of eminent domain to
WITNESS, My hand officially as such Village Clerk and the
