VILLAGE COUNCIL OF
PLYMOUTH, MINNESOTA
IN
Pursuant to due call and notice thereof, a ns;udomc- special meeting of the
Village Council of the Village of Plymouth was held on the 9th day of
October 19 71 , commencing at 10:30 A.M. o'clock Rath at the Village
Hall. 13800 State Highway R55.
The following members were present:
Mayor Rilde, Councilmen Johnson, Hintz, Spaeth and Sunt.

Councilman Hintz introduced the following resolution and moved its
adoption:

RESOLUTION No. 71-389
A RESOLUTION CONFIRMING AND ADOPTING
THE ASSESSMENT FOR
WEST SIDE MEDICINE LAKE SEWER, WATER AND STORK SEWER
IMPROVEMENT PROJECT 071-1.2,0,&-A
WHEREAS. pursuant to due and proper notice according to law an assessment
hearing wns held on the 5th of October, 1971
relating to special assessments
and,
WHERE -As, all persons present desiring to be heard were beard and their objections,
if an -v, were toted
NOW, THEREFORE, BE IT HERESY RESOLVED BY THE VILLAGE CMNCIL OF THE VILLAGE OF
PLYMOUTH, MINNESOTA, AS FOLLOWS:
"1. The Village Clerk has, with the assistance of the Bosestroo, Rosen 6 Anderlik
engineers heretofore selected by this council for such purpose, calculated
the proper amounts to be specially assessed for
the West Medicine Lake Sewer, Water and Storm Sewer Improvements.
against every assessable lot, piece or parcel -of land, in accordance
with the provisions of law, and has prepared and filed in his office
tabulated statements in duplicate showing the proper description of
each and every lot, piece.or parcel of land to be specially assessed
in the amount calculated against the same,
2. Notice has been duly published as required by law that this council
would meet in regular session at this time and place to pass on the
proposed assessmnnt..

3. The proposed assessment has at all times since its filing been open to
inspection and copying by all persons interested, and an opportunity
has been given to all interested persons to present their objections,
if any, to such proposed assessment, or to any item thereof, and
10 objections have been filed.
4. This Council finds that each of the lots, pieces or parcels of land
enumerated in said proposed assessment was and is specially benefited
by the construction of the West Medicine Lake Sewer, Water and
Storm Sewer Improvements.
in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land and that said amount is hereby
levied and assessed.
5. Such proposed assessment is affirmed, adopted and confirmed, and the
sums fixed and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed, adopted
and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively.
6. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clerk and filed in his office and shall thereupon be
and constitute the special assessment for the West Side Medicine Lake
Sewer, Water and Storm Sewer Improvements.
7. The amounts assessed against each lot, piece or parcel of land shall
bear interest from the date hereof until the same have been paid at
the rate of g percent per annum.
S. Such assessments shall be payable in 20 equal annual installments
payable on the 1st day of January in each year, beginning in the year
19 72, and continuing until all of said installments shall have been
paid, each installment to be collected with taxes collectable during
said year by the County Auditor. To the first installment shall be
added interest on the entire assessment from the date hereof to
December 31, 19_x, To each subsequent installment shall be added
interest for one year on all unpaid installments.
9. The Village Clerk is hereby directed to make up and file in the office
of the County Auditor of Hennepin County a certified statement of the
amount of all of such unpaid assessments and the amount which will be
due thereon on the 1st day of January in each year."
-The above -motion was seconded by Councilman Johnson and upon vote being
taken thereon, the following voted in favor thereof:

I, the undersigned, being the duly qualified Village Clerk
of the Village of Plymouth, Minnesota, hereby certify that I have
carefully compared the attached and foregoing Extract of Minutes of special
Bear Meeting of the Village Council of the Village of Plymouth held
October 9, 1971 with the original thereof on file in the Village
office and the same is a full, true and complete transcript therefrom
