The following members were present: Mayor Hilde, Councilmen Johnson, Hintz. Spaeth and Hunt. the following members were absent: none. • • • • • • Councilman Hintz introduced the following resolution and moved its adoption: (Levy 15328) RESOLUTION No. 71-386 A RESOLUTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR 34TH AVENUE & XENIUM LANE SEWER & WATER IMPROVEMENT PROJECT 068-1.0-C NHEREAS, pursuant to due and proper notice according to law an assessment hearing was held on the October 5, 1971 relating to special assessments and, WHEREAS, all persons present desiring to be heard were heard and their objections, if any, were noted NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH, MINNESOTA, AS FOLLOWS: "1. The Village Clerk has, with the assistance of the Bonestroo, Anderlik, & Rosene I engineers heretofore selected by this council for such purpose, calculated the proper amounts to be specially assessed for the 34th Aveneu and Xenium Lane Sewer, Water and Street Improvements. against every assessable lot, piece or parcel •of land, in accordance with the provisions of law, and has prepared and filed in his office tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount cslcvlated against the same, 2. Notice has been duly published as required by law that this council Would meet in regular session at this time and place to pass on the proposed assessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and no objections have been filed. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the construction of the 34th Avenue and Xenium Lane Sewer, Water and Street Improvements in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. 5.. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for the 34th Avenue and Xenium Lane Sewer, Water and Street Improvements. 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of B percent per annum. S. Such assessments shall be payable in 20 equal annual installments payable on the 1st day of January in each year, beginning in the year 19 72 , and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectable during said year by the County Auditor. To the first installment shall be added interest on the entire assessment from the date hereof to December 31, 19 71, To each subsequent installment shall be added interest for one yea on all unpaid installments. 9. The Village Clerk is hereby directed to make up and file in the office of the County auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon on the let day of January in each year."
