PLYMOUTH, MINNESOTA Pursuant to due call and notice thereof, a =SuAxw - special meeting of the Village Council of the Village of Plymouth was held on the 9th day of October , 19 71 , commencing at 10:30 A.M. o'clock mil. at the Village Hall, 13800 State Highway #55. The following members were present: Mayor Hilde, Councilmen Johnson, Hintz, Spaeth and Hunt. the following members were absent: none. s s • f • • -Councilman Hintz introduced the following resolution and moved its adoption: - (Levy #5327) RESOIDTION NO. 71-385 A RESOIDTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR PA_R_KE_RS LAKE SEWER, WATER AND STREET IMPROVEMENT PROJECT NO. 70-1.0,8-A WHEREAS, pursuant to due and proper notice according to law an assessment -hearing was held on the 5th of October, 1971. _._relating to -.special assessments. _1 and, —WHEREAS, all persons present desiring to'be beard were heard and their objections, If any, were noted NOW, THEREFORE, BE IT HERESY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF � LYllOIT1H, . MXNM--OTA.---AS -FOLLOWS: Rosene `I- The Village Clerk has, with the assistance of the Bonestroo, Anderlik 6 Associates engineers heretofore selected by this council for such purpose, calculated the proper amounts to be specially assessed for the Parkers Lake Sewep, Water and Street Iaprovements against every assessable lot, piece or parcel of land, in accordance with the provisions of law, and has prepared and filed in his office tabulated statements in duplicate showing the proper description of each and every lot, piece. or parcel of land to be specially assessed in the amount calculated against the same. 2. Notice has been duly published as required by law that this council ranId meet in regular session at thin time and place to pass on the proposed assessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and A objections have been filed. 4. This Oouncil finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the construction of Parkers Lake Sewer, Water and Street Improvements in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. 5. such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 6. said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for the Parkers Lake Sewer, Water and Street Improvements. 7. The amounts assessed against each lot, piece or parcel of land shall -bear interest from the date hereof until the same have been paid at the rate ofg percent per annum. S. Such assessments shall be payable in 20 equal annual installmentb payable on the 1st day of January in each year, beginning in the year _ �i9- 72, and contfnui.ng until all of said installments shall have been paid, each irtallment to be collected with taxes collectable during said year by -he County Auditor. To the first installment shall be added interest on the entire assessment from the date hereof to December 31, 1u 71 , To each subsequent installment shall be added -_-3aterest for one year on all unpaid installments. 9. the Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon on the lat day of January in each year." - - --'-Zhe-above motion-vasseeonded-by Cou-ncilman -Johnson -- -a-nd upon- v-ot-e being token thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hintz, Spaeth, Hunt and Johnson. the following vnted against: none Mrereupon said resolution was declared duly passed and adopted. - 2- STATS OF MINNESOTA ) COUNTY OF HENNEPIN ) as.
