HomeMy WebLinkAboutCity Council Resolution 1971-356EXTRACT OF MINUTES OF MEETING OF VILLAGE COUNCIL OF PLYMOUTH, MINNESOTA Pursuant to due call and notice thereof, a 30l6c- special meeting of the Village Council of the Village of Plymouth was held on the 9th day of October 19 71 , commencing at 10:30 A.M.0-clock *.ff. at the Village Hall, 13800 State Highway 955. The following members were present: Mayor Hilde, Councilmen Johnson, Spaeth, Hintz and Hunt. the following members were absent: none f r • Councilman Hintz introduced the following resolution and moved its adoption: (Levy /5326) RESOLUTION NO. 71-356 A RESOLUTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR CAVANAUGH ADDITION, SEWER, WATER 6 STREET IMPROVEMENT PROJJECT 971-i.!,O-C WHEREAS, pursuant to due and proper notice according to law an assessment r' hearing was held on the Sth of October, 1971 relating to special assessments. and, WHEREAS, all persons present desiring to be heard were heard and their objections, . If any, were noted NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH, HINKESOTA, AS FOLLMS: "1. The Village Clerk has, with the assistance of the lanestroo. Rosen i Anderlik engineers heretofore selected by this council for such purpose, calculated the proper ambunts to be specially assessed for The Cavanaugh Addition, Sewer, Water and Street Improvements, Project /71-1,2,04. against every assessable lot, piece or parcel of land, in accordance with the provisions of law, and has prepared and filed in his office tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed In the amount calculated against the one, 2. Notice has been duly published as required by law that this council would meet in regular session at this time and place to pass on the proposed aasesement. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and —1o1 objections have been filed. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the construction of the Cavanaugh Addition, Sewer, Water and Street Improvements. in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. S. Soca proposed assessment is affirmed, adopted and confLrmed, and the sums fixed and the sums fixed and named in said proposed assessment with the changes and alterations herein.:bove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for the Cavanaugh Addition Sewer, Water and Street Improvements 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of 8 percent per annum. S. Such assessments shall be payable in 20 equal annual installments payable on the 1st day of January in each year, beginning in the year 19 72, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectable during said year by the County Auditor. To the first installment shall be added interest on the entire assessment from the date hereof to December 31, To each subsequent installment shall be aided interest for one year on all unpaid installments. 9. The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon on the lot day of January in each year.,, The above motion was seconded by Councilman Johnson and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Spaeth, Hunt, Hintz and Johnson. the following vnted against: none Whereupon said resolution was declared duly passed and adopted. - 2 - STATE OF MINNESOTA ) COUNTY OF HENNEPIN ) ss.
