The following members were present: Mayor Hilde, Councilmen Hintz, Spaeth and Hunt. ~ the following members were absent: Councilman Johnson • t t • t t f t t Councilman Spaeth introduced the following resolution and moved its adoption: (Levy #5325) RESOIUTION NO. 71-355 A RESOLUTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR JONQUIL LANE SEWER, WATER AND STREET IMPROVEMENTS, PROJECT 171-1,A WHEREAS, pursuant to due and proper notice according to law an assessment hearing wds held on the 30th day of September, 1971. relating to and, special assessments WHEREAS, all persons present desiring to be heard were heard and their objections, If any, were noted NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH, MINNESOTA, AS FOLLOWS: 111. The Village Clerk has, with the assistance of the Bonestroo, Anderlik 6 Rosene engineers heretofore selected by this council for such purpose, calculated the proper amounts to be specially assessed for the Jonquil Lane Sewer, Water and Street Improvements against every assessable lot, piece or parcel of land, in accordance with the provisions of law, and has prepared and filed in his office tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same, Z. Notice has been duly published as required by law that this council Mould meet in regular session at this time and place to pass on the proposed assessment. 0 3. The proposed assessment has at all times since its filing been open_ to inspection and copying by all persons interested, and an opportunity has been given to all interested persons to present their objections, if any, to such proposed assessment, or to any item thereof, and 5 objections have been filed. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the constriction of the Jonquil Lane Sewer, Water and Street Improvements. • in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. 5. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. ' 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assessment for the Jonquil Lane Sewer, Water and Street Improvements. 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of g percent per annum. S. 'Such assessments shall be payable in 30 equal annual installments payable on the 1st day of January in each year, beginning in the year 19JL and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectable during said year by the County Auditor. To the first installment shall be added interest on the entire assessment from the date hereof to December 31, 19 71 , To each subsequent installment shall be added interest for one year on all unpaid installments. ' 9. The Village Clerk is hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon on the let day of January in each year." The above motion was seconded by Councilman Hunt and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hintz, Spaeth and Hunt. the following 1 -ted against: nons Whereupon said resolution was declared duly passed and edopted. VILLAGE OF PLYMOUTH) I, the undersigned, being the duly qualified Village Clerk of the Village of Plymouth, Minnesota, hereby certify that I have carefully compared the attached and foregoing Extract of Minutes of Special ikqpam Meeting of the Village Council of the Village of Plymouth held Sept. 30, 1971 with the original thereof on file in the Village office and the same is a full, true and complete transcript therefrom as the same relates to authorizing the use of eminent domain to WITNESS, My hand officially as such Village Clerk and the corporate seal of the Village this 12th day of October , 1971.
