Pursuant to due call and notice thereof, a - special meeting of the
Village Council of the Village of Plymouth was held on the 30th day of
September , 19 71 , commencing at 7015 o'clock Y.M. at the
Beacon Heights Elementary School.
The following members were present,

A RESOLUTION CONFIRMING AND ADOPTING

PROJECT #70-8.0

NOW, THEREFORE, BE IT HERESY RHSOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE C?

•1. The Village Clerk has, with the assistance of the Bonestroo, Rosen 6 Miderlik Assoc.
engineers heretofore selected by this council for such purpose, calculated
the proper amounts to be specially assessed for
36th Avenue (Zachary to Pilgrim Lanes) Stre9t Improvement.
against every assessable lot, piece or parcel of land, in accordance
with the provisions of law, and has prepared and filed in his office
r ------tabulated statements in duplicate showing the proper description of
S each and every lot, piece or parcel of land to be specially assessed
in the amount calculated against the same,

would meet in regular session at this time and place to pass on the
proposed assessment.
3. The proposed assessment has at all times since its filing been open to
inspection and copying by all persons interested, and an opportunity
has been given to all interested persons to present their objections,
if any, to such proposed assessment, or to any item thereof, and
no objections have been filed.
4. This Council finds that each of the lots, pieces or parcels of land
enumerated in said proposed assessment was and is specially benefited
by the construction of
the 36th Avenue (Zachary to Pilgrim Lanes) Street Improvement
in the amount in said proposed assessment set opposite the description
of each such lot, piece or parcel of land and that said amount is hereby
levied and assessed.
5. Such proposed assessment is affirmed, adopted and confirmed, and the
sums fixed and the sums fixed and named in said proposed assessment
with the changes and alterations hereinabove made are affirmed, adopted
and confirmed as the proper special assessment for each of said lots,
pieces or parcels of land respectively.
6. Said assessment so affirmed, adopted and confirmed shall be certified
to by the Village Clerk and filed in his office and shall thereupon be
and constitute the special assessment for
the 36th Avenue (Zachary to Pilgrim Lanes) Street Improvement
7. The amounts assessed against each lot, piece or parcel of land shall
bear interest from the date hereof until the same have been paid at
the rate of 8 percent per annum.

8. Such assessments shall be payable in 10 equal annual installments
payable on the lot day of January in each year, beginning in the year
19 7?, and continuing until all of said installments shall have been
paid, each installment to be collected with taxes collectable during
said year by the County Auditor. To the first installment shall be
added interest on the entire assessment from the date hereof to
December 31, 19 71 , To each subsequent installment shall be added
interest for one year on all unpaid installments.
9. The Village Clerk is hereby directed to make up and file in the office
of the County Auditor of Hennepin County a certified statement of the
amount of all of such unpaid assessments and the amount which will be
due thereon on the lot day of January in each year."
The above motion was seconded by Councilman Hunt and upon vote being
taken thereon, the following voted in favor thereof: Mayor Hilda, Councilmen Hints,
Spaeth and Hunt

Whereupon said resolution was declared duly passed and adopted.
