HomeMy WebLinkAboutCity Council Resolution 1971-352W EXTRACT OF MINUTES OF MEETING OF VILLAGE COUNCIL OF PLYMOUTH, MINNESOTA Pursuant to due call and notice thereof, a sx*mbw - spial mtcting of the Village Council of the Village of Plymouth was held on the 3n day of SeRtember 19_2L_, commencing at7;15 o'clock P.M. at the VLUXP Beacon Heights Elementary School, 12315 Highway 055 The following members were presents Mayor Bilde, Councilmen Hintz, Spaeth and Hunt the following members were absent: Councilman Johnson • • • -Councilman Hintz introduced the following resolution and moved its adoption: (Levy 45322) RESOLUTION NO. 71-352 A RESOLUTION CONFIRMING AND ADOPTING THE ASSESSMENT FOR DUNKIRK LANE STREET IMPROVEMENT - PROJECT 070-8,l WHE:RFAS, pursuant to due and proper notice according to law an assessment hearing vis held on the September 30, 1971 relating to special assessments and, WHEREAS, all persons present desiring to be heard were heard and their objections, if any, were noted ON, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH, MINNESOTA, AS FOLLOWS: 111. The Village Clerk has, with the assistance of the lOnestron. Anderlik i.Rosene As engineers heretofore selected by this council for such purpose, calculated the proper amounts to be specially assessed for the Dunkirk Lane Street Improvement Project :170-8,E against every assessable lot, piece or parcel 'of land, in accordance with the provisions of law, and has prepared and filed in his office tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same, 2, Notiemo has been duly published as required by law that this council w ald meet in regular session at this time and place to Wass on the proposed assessment. 40 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons interested, and an opportunity has been given to all Interested persons to present their objections, if any, to such proposed assessment, or to'any item thereof, and no objection.- have been filed. 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefited by the construction of the Dunkirk Lane Street Improvement in the amount in said proposed assessment set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. S. Such proposed ass_-:;sment is affirmed, adopted and confirmed, and the sums fixed and the sums J'ixed and named in said proposed assessment with the changes and alt :rations hereinabove made are affirmed, adopted_ and confirmed as the proper special assessment for each of said lots, pieces or parcels of land respectively. 6. said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in -his office and shall thereupon be and constitute the special assessment for the Dunkirk Lane Street Improvement 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at 'the rate of 8 percent per annum. S. Such assessments shall be payable in 10 equal annual installments payable on the lot day of January in each year, beginning in the year 19 72, and continuing until all of said installments shall have been paid, each installment to be collected with taxes collectable during said year by the County Auditor. To the first installment shall be added interest on the entire assessment from the date hereof to December 31, 19_U, To each subsequent installment shall be added interest for one year on all unpaid installments. 9. The Village Clerk i..a hereby directed to make up and file in the office of the County Auditor of Hennepin County a certified statement of. the amount of all of such %Lnpaid assessments and the amount which will be due thereon on the let day of January in each year."
