HomeMy WebLinkAboutCity Council Resolution 1971-348CEXTRACT OF MINUTES OF MEETING OF VILLAGE COUNCIL OF PLYMOUTH, MINNESOTA Pursuant to due call and notice thereof, a special meeting of the Village Council of the Village of Plymouth, Minnesota, was held on the 30th of September 1971 commencing at 7:20 p.m. at the Beacon Heights Elementary School, 12315 Highway 1155, Minneapolis, Minnesota. The following members were present: Mayor Pilde, Councilmen Hintz, Spaeth & Hunt. The following member was absent: Councilman Johnson Councilman Hintz introduced the follwoing Resolution and moved Its adoption: RESOLUTION NO. 71-348-C (Levy 5319) A RESOLUTION CONFIRMING & ADOPTING THE ASSESSMENT FOR STREET LIGHTING IN 7 PONDS ADDITION WHEREAS, pursuant to due and proper notice according to law an assessment hearing was held on the 30th of September 1971, relating to street lighting costs for Seven Ponds Addition ,. and WHEREAS, all persons present desiring to be heard were heard and their objections, if any, were noted, NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE VILLAGE COUNCIL OF THE VILLAGE OF PLYMOUTH, MINNESOTA, AS FOLLOWS: "1. The acting Village Clerk has, with the assistance of the Village Finance Director heretofore selected by this Council for such purpose, calculated the proper amounts to be specially assessed for street lighting in Seven Ponds Addition against every assessable lot, piece o parte o land, in accordance with the provisions of law, and has prepared and filed In this office tabulated statements in duplicate showing the proper description of each and every lot, piece or parcel of land to be specially assessed in the amount calculated against the same, 2. Notice has been duly published as required by law that this Council would meet in regular session at this time and place to pass on the proposed assessment. 3. The proposed assessment has at all times since its filing been open to inspection and copying by all persons inter- ested, and an opportunity has been given to all interested persons to present their objections, if any, to such pro- posed assessment, or to any item thereof, and no objections have been filed. (Resolution No. 71-348-C) 4. This Council finds that each of the lots, pieces or parcels of land enumerated in said proposed assessment was and is specially benefitted by the construction of such street lighting in the amount in said proposed assessmegt set opposite the description of each such lot, piece or parcel of land and that said amount is hereby levied and assessed. S. Such proposed assessment is affirmed, adopted and confirmed, and the sums fixed and named in said proposed assessment with the changes and alterations hereinabove made are affirmed, adopted and confirmed as the proper special assessment for each of said lots, pieces of parcels of land respectively. 6. Said assessment so affirmed, adopted and confirmed shall be certified to by the Village Clerk and filed in his office and shall thereupon be and constitute the special assess- ment for street lighting costs for Seven Ponds Addition 7. The amounts assessed against each lot, piece or parcel of land shall bear interest from the date hereof until the same have been paid at the rate of zero percent per annum. S. Such assessments shall be payable in one equal annual Installment payable on the first day of January in each year, beginning in the year 1972, and continuing until all of said installments shall have been paid, each in- stallment to be collected with taxes collectable during said year by the County Auditor. To the first installment shall be added interest on the entire assessment from the date hereof to December 31, 1971. To each subsequent In- stallment shall be added interest for one year on all unpaid installments. 9. The Village Clerk is hereby directed to make up and file In the office of the County Auditor of Hennepin County a certified statement of the amount of all of such unpaid assessments and the amount which will be due thereon the first day of January in each year." The above motion was seconded by Councilman Hunt and upon vote being taken thereon, the following voted in favor thereof: Mayor Hilde, Councilmen Hints, Spaeth, Hunt. No one voted against. Whereupon said Resolution was declared duly passed and adopted. STATE OF MINNESOTA ) COUNTY OF HENNEPIN ) SS. VILLAGE OF PLYMOUTH) I, the undersigned being the duly qualified and acting Clerk of the Village of Plymouth, Minnesota, hereby certify that I have carefully compared the attached and foregoing extract of minutes of a special meeting of the Village Council of said Village held September 30th 1971 with the original thereof on file in my office and the same is a full, true and complete transcript therefrom insofar as the same relates to street lighting.
